2827 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 25

3029 SECTION 1. Arkansas Code ยง 11-3-204(a)(1), concerning the information 27
3130 that may be disclosed by a current or former employer to a prospective 28
3231 employer, is amended to read as follows: 29
3332 (a)(1) A current or former employer may disclose the following 30
3433 information about a current or former employee's employment history to a 31
3534 prospective employer of the current or former employee upon receipt of 32
3635 written consent from the current or former employee: 33
3736 (A) Date and duration of employment; 34
3837 (B) Current pay rate and wage history; 35

4544 (F) Results of drug or alcohol tests administered within 4

4847 behavior related to the workplace or directed at another employee; 7
4948 (H) A substantiated allegation of sexual abuse or sexual 8
5049 harassment by the employee, or the resignation by a former employee during a 9
5150 pending investigation of an allegation of sexual abuse or sexual harassment 10
5251 against the former employee; 11
5352 (I) Whether the employee was voluntarily or involuntarily 12
5453 separated from employment and the reasons for the separation; and 13
