BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 21

SECTION 1. Arkansas Code ยง 4 -19-102(1), concerning the definition of 23
"transmitting utility" under the Transmitting Utility Act, is amended to read 24
as follows: 25
(1) "Transmitting utility" means any a corporation or other 26
entity primarily engaged in : 27
(A) the The railroad or street railway business ,; 28
(B) the The furnishing of telephone or telegraph service ,; 29
(C) the The transmission of oil, gas, or petroleum 30
products by pipeline , or; 31
(D) the The production, transmission, or distribution of 32
electricity, steam, gas, or water ; or 33
(E) The provision of fiber optic communication service, 34
broadband internet service, or similar high -speed data transmission services .35
