23	21		BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 19

25	23		SECTION 1. DO NOT CODIFY. Legislative findings and intent. 21
26	24		(a) The General Assembly finds that: 22
27	25		(1) The railroads of this state are essential to the 23
28	26		functionality of the state; and 24
29	27		(2) It is the obligation of the General Assembly to protect 25
30	28		railroads from interference as an essential cog of the transportation 26
31	29		infrastructure of the state. 27
32	30		(b) The General Assembly intends for this act to eliminate to the 28
33	31		extent possible the acts of tampering with, displacing, removing, damaging, 29
34	32		disabling, destroying, setting fire to, impairing, or otherwise interfering 30
35	33		with rail transport by creating penalties for tampering with, displacing, 31
36	34		removing, damaging, disabling, destroying, setting fire to, impairing, or 32
37	35		otherwise interfering with rail infrastructure. 33

46	42		(a) As used in this section: 2
47	43		(1) "Interfere" means to tamper with, displace, remove, damage, 3
48	44		disable, destroy, set fire to, impair, obstruct, or otherwise hinder; and 4
49	45		(2) "Rail infrastructure" means the following that are located 5
50	46		on property owned by a railroad or property owned, leased, possessed, 6
51	47		operated, or otherwise used for or in connection with railroad operations: 7
52	48		(A) A train, locomotive, freight car, passenger car, or 8
53	49		any other on-track vehicle or on-track equipment; 9
54	50		(B) A railroad track or structure; 10
55	51		(C) A signaling or communication system or component; and 11
56	52		(D) A station, terminal, depot, or other facility. 12
57	53		(b) A person commits the offense of tampering with rail infrastructure 13
58		-	if he or she ~~without lawful authority or permission~~ : 14

59	55		(1) Recklessly: 15
60	56		(A) Places an obstruction on or within or interferes with 16
61	57		a: 17
62	58		(i) Part or securement of a rail, track, tie, 18
63	59		switch, ballast, or other fixture or device; 19
64	60		(ii) Bridge, tunnel, viaduct, tower, culvert, drain, 20
65	61		trestle, embankment, parapet; or 21
66	62		(iii) Structure that is attached to, connected to, 22
67	63		or used with railroad tracks or for the operation of any railroad 23
68	64		infrastructure; 24
69	65		(B) Interferes with a: 25
70	66		(i) Signal, mechanism, device, piece of equipment, 26
71	67		bungalow, communication line or antenna, or other appurtenance used in 27
72	68		controlling the signal or communication systems of rail infrastructure; 28
73	69		(ii) Train control system; 29
74	70		(iii) Centralized dispatching system; 30
75	71		(iv) Wayside detector; 31
76	72		(v) Communication tower; 32
77	73		(vi) Buried or aerial facility; or 33
78	74		(vii) Highway-rail grade crossing warning system; 34
79	75		(C) Places or releases a biological agent or toxin, 35

86	80		(D) Detaches, initiates an emergency brake application, or 2
87	81		otherwise impedes the movement of rail infrastructure; 3
88	82		(E) Assaults or injures a rail passenger, railroad 4
89	83		employee, or police officer of a railroad or a person on or within rail 5
90	84		infrastructure; 6
91	85		(F) Makes a terroristic threat to commit any of the acts 7
92	86		described in subdivisions (b)(1)(A) -(E) of this section; or 8
93	87		(G) Attempts, threatens, or conspires with others to 9
94	88		commit any of the acts described in subdivisions (b)(1)(A) -(F) of this 10
95	89		section; or 11
96	90		(2) Knowingly conveys false information or reports regarding an 12
97	91		attempt or alleged attempt to commit any of the acts described in 13
98	92		subdivisions (b)(1)(A) -(F) of this section. 14
99	93		(c) The offense of tampering with rail infrastructure is a Class D 15
100	94		felony. 16
