2424 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 22

2626 SECTION 1. Arkansas Code § 6 -18-2506(a)(3)(A)(i)(e)-(g), concerning 24
2727 student eligibility for the Arkansas Children's Educational Freedom Account 25
2828 Program, is amended to read as follows: 26
2929 (e) A child of active -duty uniformed service 27
3030 personnel, as identified under Title 10, Title 32, Title 33, or Title 42 of 28
3131 the United States Code; or 29
3232 (f) A student who was enrolled in the previous 30
3333 school year in a: 31
3434 (1) Public school that has a rating of 32
3535 “F” under §§ 6-15-2105 and 6-15-2106 and State Board of Education rules; or 33
3636 (2) Public school district classified as 34
3737 in need of Level 5 — Intensive support under § 6 -15-2913 or § 6-15-2915; or 35

4343 SECTION 2. Arkansas Code § 6 -18-2506(a)(3)(C) is amended to read as 3
4444 follows: 4
4545 (C)(i) For the 2025-2026 school year and each year 5
4646 thereafter, any resident of this state who is eligible to enroll in a public 6
4747 elementary or secondary school shall be eligible student eligibility shall 7
4848 include students who meet at least one (1) of the following: 8
4949 (i) A student who is eligible under subdivision 9
5050 (a)(3)(B)(i) of this section; 10
5151 (ii) A student who is continuing to participate in 11
5252 the Arkansas Children's Educational Freedom Account Program from the 2024 -12
5353 2025 school year; or 13
5454 (iii) A resident of this state who is eligible to 14
5555 enroll in a public elementary or secondary school if: 15
5656 (a) His or her family has a gross family 16
5757 income not exceeding two hundred fifty percent (250%) of the federal poverty 17
5858 level; 18
5959 (b)(1) His or her family has a gross family 19
6060 income exceeding two hundred fifty percent (250%) of the federal poverty 20
6161 level but not exceeding three hundred fifty percent (350%) of the federal 21
6262 poverty level. 22
6363 (2) However, a student eligible for an 23
6464 account under subdivision (a)(3)(C)(iii)(b)(1) of this section shall receive 24
6565 only fifty percent (50%) of the prior year's statewide foundation funding 25
6666 allocated per student under § 6 -20-2305; or 26
6767 (c)(1) His or her family has a gross family 27
6868 income exceeding three hundred fifty percent (350%) of the federal poverty 28
6969 level but not exceeding four hundred percent (400%) of the federal poverty 29
7070 level. 30
7171 (2) However, a student eligible for an 31
7272 account under subdivision (a)(3)(C)(iii)(c)(1) of this section shall receive 32
7373 only twenty-five percent (25%) of the prior year's statewide foundation 33
7474 funding allocated per student under § 6 -20-2305. 34
7575 (ii) Beginning with the 2025 -2026 school year, there 35
7676 shall be no limitation on student participation in the Arkansas Children's 36 HB1761
