24	24	BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 22

26	26	SECTION 1. Arkansas Code § 6 -18-2506(a)(3)(A)(i)(e)-(g), concerning 24
27	27	student eligibility for the Arkansas Children's Educational Freedom Account 25
28	28	Program, is amended to read as follows: 26
29	29	(e) A child of active -duty uniformed service 27
30	30	personnel, as identified under Title 10, Title 32, Title 33, or Title 42 of 28
31	31	the United States Code; or 29
32	32	(f) A student who was enrolled in the previous 30
33	33	school year in a: 31
34	34	(1) Public school that has a rating of 32
35	35	“F” under §§ 6-15-2105 and 6-15-2106 and State Board of Education rules; or 33
36	36	(2) Public school district classified as 34
37	37	in need of Level 5 — Intensive support under § 6 -15-2913 or § 6-15-2915; or 35

43	43	SECTION 2. Arkansas Code § 6 -18-2506(a)(3)(C) is amended to read as 3
44	44	follows: 4
45	45	(C)(i) For the 2025-2026 school year and each year 5
46	46	thereafter, any resident of this state who is eligible to enroll in a public 6
47	47	elementary or secondary school shall be eligible student eligibility shall 7
48	48	include students who meet at least one (1) of the following: 8
49	49	(i) A student who is eligible under subdivision 9
50	50	(a)(3)(B)(i) of this section; 10
51	51	(ii) A student who is continuing to participate in 11
52	52	the Arkansas Children's Educational Freedom Account Program from the 2024 -12
53	53	2025 school year; or 13
54	54	(iii) A resident of this state who is eligible to 14
55	55	enroll in a public elementary or secondary school if: 15
56	56	(a) His or her family has a gross family 16
57	57	income not exceeding two hundred fifty percent (250%) of the federal poverty 17
58	58	level; 18
59	59	(b)(1) His or her family has a gross family 19
60	60	income exceeding two hundred fifty percent (250%) of the federal poverty 20
61	61	level but not exceeding three hundred fifty percent (350%) of the federal 21
62	62	poverty level. 22
63	63	(2) However, a student eligible for an 23
64	64	account under subdivision (a)(3)(C)(iii)(b)(1) of this section shall receive 24
65	65	only fifty percent (50%) of the prior year's statewide foundation funding 25
66	66	allocated per student under § 6 -20-2305; or 26
67	67	(c)(1) His or her family has a gross family 27
68	68	income exceeding three hundred fifty percent (350%) of the federal poverty 28
69	69	level but not exceeding four hundred percent (400%) of the federal poverty 29
70	70	level. 30
71	71	(2) However, a student eligible for an 31
72	72	account under subdivision (a)(3)(C)(iii)(c)(1) of this section shall receive 32
73	73	only twenty-five percent (25%) of the prior year's statewide foundation 33
74	74	funding allocated per student under § 6 -20-2305. 34
75	75	(ii) Beginning with the 2025 -2026 school year, there 35
76	76	shall be no limitation on student participation in the Arkansas Children's 36 HB1761
