2826 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 24

3028 SECTION 1. Arkansas Code Title 19, Chapter 6, Subchapter 8, is amended 26
3129 to add an additional section to read as follows: 27
3230 19-6-846. Arkansas Revenue Investment in Vital EMS Systems (ARRIVES) 28
3331 Fund. 29
3432 (a) There is created on the books of the Treasurer of State, the 30
3533 Auditor of State, and the Chief Fiscal Officer of the State a special revenue 31
3634 fund to be known as the “Arkansas Revenue Investment in Vital EMS Systems 32
3735 (ARRIVES) Fund”. 33
3836 (b) The fund shall consist of such revenues as may be authorized by 34
3937 law. 35

4844 SECTION 2. Arkansas Code Title 20, Chapter 13, is amended to add an 4
4945 additional subchapter to read as follows: 5
5046 Subchapter 19 — ARRIVES Act 6

5248 20-13-1901. Title. 8
5349 This subchapter shall be known and may be cited as the "Arkansas 9
5450 Revenue Investment in Vital EMS Systems (ARRIVES) Act". 10

5652 20-13-1902. Eligibility. 12
5753 (a) To be eligible for funding under this subchapter, an emergency 13
5854 medical services agency shall: 14
5955 (1) Be actively licensed and in good standing in the state for 15
6056 no less than three (3) years from the date of the application for funding; 16
6157 (2) Be the provider of record for a county or municipality for a 17
6258 minimum of twelve (12) months unless the provider of record has been selected 18
6359 by the county or municipality through a competitive bid process; and 19
6460 (3) Offer emergency ground ambulance services at the: 20
6561 (A) Advanced life support level; or 21
6662 (B) Basic life support level if the funds will be used to 22
6763 license and operate an ambulance at the advanced live support level within 23
6864 one year of receiving funding. 24
6965 (b) An emergency medical services agency is not eligible to apply for 25
7066 funding under this subchapter if the agency: 26
7167 (1) Is currently under a state sanction or disciplinary action; 27
7268 (2) Is currently under a Corporate Integrity Agreement with the 28
7369 United States Office of the Inspector General; 29
7470 (3) Provides non-emergency transport; 30
7571 (4) Is licensed as a volunteer emergency medical services 31
7672 provider; or 32
7773 (5) Is a first responder agency that does not provide ambulance 33
7874 operations at the advanced life support level twenty -four (24) hours a day. 34

8579 (a) An emergency medical services agency shall apply with the State 1
8680 Board of Health for funding under this subchapter. 2
8781 (b) An emergency medical services agency applying for funding under 3
8882 this subchapter shall include in its application the following documentation: 4
8983 (1) Proof of state emergency medical services licensure at the 5
9084 advanced life support level; 6
9185 (2) A certificate of good standing with the state; 7
9286 (3) Articles of incorporation; and 8
9387 (4) Proof of insurance from an agency authorized to write 9
9488 insurance in the state. 10

9690 20-13-1904. Disbursement. 12
97- (a) Any moneys assessed for disbursement from the Arkansas Revenue 13
98-Investment in Vital EMS Systems (ARRIVES) Fund, § 19 -6-846, by the Department 14
99-of Health shall be disbursed to eligible emergency medical services agencies 15
100-as described in subsection (b) of this section. 16
91+ (a) The premium tax moneys assessed for disbursement from the Arkansas 13
92+Revenue Investment in Vital EMS Systems (ARRIVES) Fund, § 19 -6-846, by the 14
93+Department of Health shall be disbursed to eligible emergency medical 15
94+services agencies as described in subsection (b) of this section. 16
10195 (b)(1) Each county shall be designated a tier based on its population 17
10296 at the time of the most recent federal decennial census as follows: 18
10397 (A) A county having one hundred thousand (100,000) 19
10498 inhabitants or more is designated Tier 1; 20
10599 (B) A county having fifty thousand (50,000) inhabitants or 21
106100 more, but fewer than one hundred thousand (100,000) inhabitants, is 22
107101 designated Tier 2; 23
108102 (C) A county having twenty -five thousand (25,000) 24
109103 inhabitants or more, but fewer than fifty thousand (50,000) inhabitants, is 25
110104 designated Tier 3; 26
111105 (D) A county having ten thousand (10,000) inhabitants or 27
112106 more, but fewer than twenty -five thousand (25,000) inhabitants, is designated 28
113107 Tier 4; and 29
114108 (E) A county having fewer than ten thousand (10,000) 30
115109 inhabitants, is designated Tier 5. 31
116110 (2) The department shall disburse the moneys to the qualified 32
117111 emergency medical services agencies of a county in the following percentages 33
118112 based on the designated tier in which an emergency medical services agency is 34
119113 located: 35
