BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 19

SECTION 1. Arkansas Code Title 18, Chapter 4, Subchapter 1 is amended 21
to add an additional section to read as follows: 22
18-4-101. Generative artificial intelligence tool — Ownership of model 23
training and generated content. 24
(a) Except as described under subsection (b) of this section, if a 25
person uses a generative artificial intelligence tool to generate content, 26
the model training and content generated from the generative artificial 27
intelligence tool shall be the property of that person. 28
(b) If a person or entity employs a person and directs that person to 29
use a generative artificial intelligence tool to conduct model training and 30
generate content for the purposes of conducting business, the model training 31
and content generated from the generative artificial intelligence tool shall 32
be the property of the person or entity directing the employee to conduct the 33
model training and generate the content. 34
