2322 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 20

2524 SECTION 1. Acts 2025, No. 408, ยง 23, is amended to read as follows: 22
2625 SECTION 23. EMERGENCY CLAUSE. It is found and determined by the 23
2726 General Assembly, that the Constitution of the State of Arkansas prohibits 24
2827 the appropriation of funds for more than a one (1) year period; that the 25
2928 effectiveness of this Act on July 1, 2026 2025 is essential to the operation 26
3029 of the agency for which the appropriations in this Act are provided; with the 27
3130 exception that Sections 15 and 20 in this Act shall be in full force and 28
3231 effect from and after the date of its passage and approval; and that in the 29
3332 event of an extension of the Session, the delay in the effective date of this 30
3433 Act beyond July 1, 2026 2025, with the exception that Sections 15 and 20 in 31
3534 this Act shall be in full force and effect from and after the date of its 32
3635 passage and approval, could work irreparable harm upon the proper 33
3736 administration and provision of essential governmental programs. Therefore, 34
3837 an emergency is hereby declared to exist and this Act being necessary for the 35
3938 immediate preservation of the public peace, health and safety shall be in 36 HB1927

4241 full force and effect from and after July 1, 2026 2025; with the exception of 1
4342 Sections 15 and 20 in this Act shall be in full force and effect from and 2
4443 after the date of its passage and approval. 3

4645 SECTION 2. EMERGENCY CLAUSE. It is found and determined by the 5
4746 General Assembly of the State of Arkansas that the office of the Secretary of 6
4847 State provides vital services, including without limitation the regulation of 7
4948 elections and the registration of business entities, that preserve the public 8
5049 peace, health, and safety; that due to an error in Acts 2025, No. 408, 9
5150 funding for the office would lapse when its current appropriation expires at 10
5251 the end of the current fiscal year; and that the immediate effectiveness of 11
5352 this act is necessary to preserve the public peace, health, and safety as it 12
5453 will ensure that funding for the office is in place at the beginning of the 13
5554 next fiscal year and allow proper planning for the fiscal operations of the 14
5655 office. Therefore, an emergency is declared to exist, and this act being 15
5756 immediately necessary for the preservation of the public peace, health, and 16
5857 safety shall become effective on: 17
5958 (1) The date of its approval by the Governor; 18
6059 (2) If the bill is neither approved nor vetoed by the Governor, 19
6160 the expiration of the period of time during which the Governor may veto the 20
6261 bill; or 21
6362 (3) If the bill is vetoed by the Governor and the veto is 22
6463 overridden, the date the last house overrides the veto. 23
