|---|
| 46 | 45 | | (3) Affected district resulted in a consolidation within the 5 |
|---|
| 47 | 46 | | last twenty (20) years from the effective date of this section; and 6 |
|---|
| 48 | 47 | | (3) Incorporated town or city of the second class has the means 7 |
|---|
| 49 | 48 | | of providing adequate school facilities. 8 |

| 50 | 49 | | (b) If a receiving school district board of directors approves the 9 |
|---|
| 51 | 50 | | written appeal of an incorporated town or a city of the second class under 10 |
|---|
| 52 | 51 | | subsection (a) of this section, the receiving school district board of 11 |
|---|
| 53 | 52 | | directors and the incorporated town or city of the second class shall jointly 12 |
|---|
| 54 | 53 | | file an appeal with the State Board of Education for the establishment of a 13 |
|---|
| 55 | 54 | | local public elementary school or satellite school associated with an 14 |
|---|
| 56 | 55 | | affected district's existing school campus, to be located within the 15 |
|---|
| 57 | 56 | | boundaries of the incorporated town or city of the second class. 16 |
|---|
| 58 | 57 | | (c)(1) A local public elementary school established in an affected 17 |
|---|
| 59 | 58 | | district under subsection (b) of this section shall be part of the receiving 18 |
|---|
| 60 | 59 | | district. 19 |
|---|
| 61 | 60 | | (2) The receiving district and the incorporated town or city of 20 |
|---|
| 62 | 61 | | the second class may enter into a written agreement for the provision of in -21 |
