2525 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 23

2727 SECTION 1. Arkansas Code Title 18, Chapter 16, Subchapter 4, is 25
2828 amended to add an additional section to read as follows: 26
2929 18-16-416. Compromised leased space — Notification required — 27
3030 Definitions. 28
3131 (a) As used in this section: 29
3232 (1) "Compromised" means that an operator has actual knowledge 30
3333 that: 31
3434 (A) A leased space has been forcibly accessed by an 32
3535 individual other than the occupant, the operator, or an individual authorized 33
3636 by the occupant or the operator; 34
3737 (B) Property has been taken from a leased space by an 35
3838 individual other than the occupant, the operator, or an individual authorized 36 HB1994

4141 by the occupant or the operator; or 1
4242 (C) A leased space has been damaged to the extent that 2
4343 property within the leased space is accessible by an individual other than 3
4444 the occupant, the operator, or an individual authorized by the occupant or 4
4545 operator; and 5
4646 (2) "Individual authorized by the occupant or operator" means an 6
4747 individual listed on the rental agreement or an individual who has the 7
4848 applicable key or code to access the leased space. 8
4949 (b) An operator shall contact an occupant who has a compromised lease 9
5050 space by telephone, email, or regular mail within five (5) business days of 10
5151 the operator's actual knowledge that the occupant's leased space has been 11
5252 compromised. 12
5353 (c)(1) This section does not impose any responsibility on the operator 13
5454 for the care, custody, or control of the occupant’s personal property. 14
5555 (2) The operator does not have a duty or obligation to determine 15
5656 whether a leased space has been compromised. 16
