21	21	BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 19

23	23	SECTION 1. Arkansas Code § 14-1-604(e), concerning the exemption for a 21
24	24	person engaged in home digital asset mining or operating a digital asset 22
25	25	mining business under the Uniform Money Services Act, is repealed. 23
26	26	(e) A person that is engaged in home digital asset mining or that has 24
27	27	a digital asset mining business shall not be considered a money transmitter 25
28	28	under the Uniform Money Services Act, § 23 -55-101 et seq. 26

30	30	SECTION 2. Arkansas Code § 23 -55-102(13)(A), concerning the definition 28
31	31	of "money transmission" under the Uniform Money Services Act, is amended to 29
32	32	add an additional subdivision to read as follows: 30
33	33	(v) engaging in home digital asset mining or 31
34	34	operating a digital asset mining business under the Arkansas Data Centers Act 32
35	35	of 2023, § 14-1-601 et seq. 33

37	37	SECTION 3. DO NOT CODIFY. A person engaging in home digital asset 35
38	38	mining or operating a digital asset mining business under the Arkansas Data 36 SB11

41	41	Centers Act of 2023, § 14 -1-601 et seq., as of the effective date of this act 1
42	42	shall apply for licensure under the Uniform Money Services Act, § 23 -55-101 2
