26	26	BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 24

28	28	SECTION 1. Arkansas Code Title 12, Chapter 41, Subchapter 5, is 26
29	29	amended to add an additional section to read as follows: 27
30	30	12-41-512. County jail state inmate close -to-home partnership. 28
31	31	(a) Two (2) or more adjoining counties of the state may enter into a 29
32	32	county jail state inmate close -to-home partnership agreement to jointly: 30
33	33	(1) Construct, expand, or improve a facility for a shared county 31
34	34	jail to house inmates awaiting transfer to the Division of Correction; and 32
35	35	(2) Manage and operate the shared county jail. 33
36	36	(b) Two (2) or more adjoining counties may enter into a partnership 34
37	37	agreement under subsection (a) of this section if: 35
38	38	(1) One (1) or more of the counties is one (1) of the eight (8) 36 SB144

41	41	counties that contribute the most inmates to the total population of the 1
42	42	Division of Correction as determined by the Division of Correction as of 2
43	43	January 1, 2025; 3
44	44	(2) The partnership agreement is approved by a vote of the 4
45	45	quorum court of each county; and 5
46	46	(3) The partnership agreement is approved by the Board of 6
47	47	Corrections. 7
48	48	(c) In addition to any sources of funding provided by law, the costs 8
49	49	associated with the construction, expansion, or improvement of a facility for 9
50	50	a shared county jail pursuant a partnership agreement under this section may 10
51	51	be provided from funds authorized by the General Assembly. 11
52	52	(d) A partnership agreement under this section must be approved by the 12
53	53	Board of Corrections before June 30, 2027. 13
