2221 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 19

2423 SECTION 1. Arkansas Code § 15 -43-205 is repealed. 21
2524 15-43-205. Negligent discharge of firearms while hunting deer. 22
2625 (a) The General Assembly has become aware of the fact that many 23
2726 persons hunting deer in this state negligently allow their firearms to be 24
2827 discharged without exercising proper care to ascertain the object at which 25
2928 they shoot, thereby endangering the life, limb, and property of other 26
3029 persons. It is the intent of this section to deter the negligent use of 27
3130 firearms by deer hunters by imposing penalties therefor. 28
3231 (b) A person who, while hunting deer, negligently discharges a firearm 29
3332 in such circumstances as to endanger the person or property of another shall 30
3433 be fined in an amount not less than one hundred dollars ($100) nor more than 31
3534 one thousand dollars ($1,000) or may be imprisoned in the county jail for a 32
3635 period not less than thirty (30) days nor more than six (6) months, or be 33
3736 both fined and imprisoned. 34
