| 26 | 25 | | (a) The General Assembly has become aware of the fact that many 23 |
|---|
| 27 | 26 | | persons hunting deer in this state negligently allow their firearms to be 24 |
|---|
| 28 | 27 | | discharged without exercising proper care to ascertain the object at which 25 |
|---|
| 29 | 28 | | they shoot, thereby endangering the life, limb, and property of other 26 |
|---|
| 30 | 29 | | persons. It is the intent of this section to deter the negligent use of 27 |
|---|
| 31 | 30 | | firearms by deer hunters by imposing penalties therefor. 28 |
|---|
| 32 | 31 | | (b) A person who, while hunting deer, negligently discharges a firearm 29 |
|---|
| 33 | 32 | | in such circumstances as to endanger the person or property of another shall 30 |
|---|
| 34 | 33 | | be fined in an amount not less than one hundred dollars ($100) nor more than 31 |
|---|
| 35 | 34 | | one thousand dollars ($1,000) or may be imprisoned in the county jail for a 32 |
|---|
| 36 | 35 | | period not less than thirty (30) days nor more than six (6) months, or be 33 |
|---|
