23 | 23 | | SECTION 1. Arkansas Code § 20 -8-107(a), concerning the expansion of 21 |
---|
24 | 24 | | facilities and services under the Health Services Permit Agency, is amended 22 |
---|
25 | 25 | | to read as follows: 23 |
---|
26 | 26 | | (a)(1) Unless otherwise provided in this subchapter, all health 24 |
---|
27 | 27 | | facilities seeking to add new beds or perform additional home health services 25 |
---|
28 | 28 | | or to expand existing bed capacity shall apply for a permit approving 26 |
---|
29 | 29 | | additional beds or services or expanded bed capacity or services pursuant to 27 |
---|
30 | 30 | | procedures and criteria promulgated by the Health Services Permit Commission, 28 |
---|
31 | 31 | | except an additional permit shall not be required for : 29 |
---|
32 | 32 | | (A) Home home health services agencies currently licensed 30 |
---|
33 | 33 | | by the Department of Health to expand geographic service areas if the home 31 |
---|
34 | 34 | | health services agency has a primary or branch office located within one 32 |
---|
35 | 35 | | hundred (100) miles of the location of the services ; or 33 |
---|
36 | 36 | | (B) Hospice agencies currently licensed by the Department 34 |
---|
37 | 37 | | of Health to expand geographic service areas if the hospice agency has a 35 |

43 | 43 | | not expand its service area except on the first day of a calendar quarter. 3 |

44 | 44 | | (B) If a home health services agency or hospice agency 4 |

45 | 45 | | seeks to expand its service area on the first day of a calendar quarter, the 5 |
---|
46 | 46 | | home health services agency or hospice agency shall notify the Department of 6 |
---|
47 | 47 | | Health and the Health Services Permit Agency at least forty -five (45) days in 7 |
---|
48 | 48 | | advance of providing any services in the expanded area. 8 |
---|
49 | 49 | | (3) The Department of Health and the Health Services Permit 9 |
---|
50 | 50 | | Agency shall record any expansion in service area in its publicly distributed 10 |
---|
51 | 51 | | records. 11 |
---|
52 | 52 | | (4) A home health service agency or a hospice agency that is 12 |
---|
53 | 53 | | providing services outside of a permitted service area shall be subject to 13 |
---|
54 | 54 | | appropriate penalties under § 20 -7-101 and § 20-10-803. 14 |
