UNDER THE WORKERS' COMPENSATION LAW THAT 19 
RESULTED FROM INITIATED MEASURE 1948, 20

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 23

 SECTION 1.  Arkansas Code § 11 -9-521(g), concerning an employee 25 
suffering a scheduled injury under the Workers' Compensation Law, is 	amended 26 
to read as follows: 27 
 (g)  Any employee suffering a scheduled injury shall not be entitled to 28 
permanent partial disability benefits in excess of the percentage of 29 
permanent physical impairment set forth above except as otherwise provided in 30 
§ 11-9-519(b) In considering a claim for permanent partial disability 31 
benefits in excess of the employee's percentage of permanent physical 32 
impairment, the Workers' Compensation Commission may take into account, in 33 
addition to the percentage of permanent physical impairment, such factors as 34 
the employee's age, education, work experience, and other matters reasonably 35 
expected to affect his or her future earning capacity . 36
