2221 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 19

2423 SECTION 1. APPROPRIATION - CAPITAL IMPROVEMENT PROJECTS . There is 21
2524 hereby appropriated, to the Department of Health , to be payable from the 22
2625 federal funds as designated by the Chief Fiscal Officer of the State , the 23
2726 following: 24
2827 (A) for steam plant conversion at the Main Campus , in a sum not to 25
2928 exceed ........................................................... $6,992,700. 26
3029 (B) for replacement of the generator at the Public Health Lab , in a sum 27
3130 not to exceed ...................................................... $820,000. 28

3332 SECTION 2. APPROPRIATION - CAPITAL IMPROVEMENT PROJECTS . There is 30
3433 hereby appropriated, to the Department of Health , to be payable from the cash 31
3534 fund deposited in the State Treasury as determined by the Chief Fiscal 32
3635 Officer of the State , the following: 33
3736 (A) for replacement of the Arkansas Department of Health main facility , 34
3837 in a sum not to exceed ......................................... $114,000,000. 35

4241 SECTION 3. APPROPRIATION - CAPITAL IMPROVEMENT PROJECTS . There is 1
4342 hereby appropriated, to the Department of Health , to be payable from the 2
4443 paying account as determined by the Chief Fiscal Officer of the State , the 3
4544 following: 4
4645 (A) for Freeway Suite 305 , in a sum not to exceed ............ $505,330. 5
4746 (B) for surface parking repair and renovation at the Main Campus , in a 6
4847 sum not to exceed .................................................. $594,651. 7
4948 (C) for switchboard modifications at the Main Public Health Lab , in a 8
5049 sum not to exceed .................................................. $250,000. 9
5150 (D) for replacement of the Arkansas Department of Health main facility , 10
5251 in a sum not to exceed .......................................... $30,031,020. 11

5453 SECTION 4. DISBURSEMENT CONTROLS. (A) No contract may be awarded nor 13
5554 obligations otherwise incurred in relation to the project or projects 14
5655 described herein in excess of the State Treasury funds actually available 15
5756 therefor as provided by law. Provided, however, that institutions and 16
5857 agencies listed herein shall have the authority to accept and use grants and 17
5958 donations including Federal funds, and to use its unobligated cash income or 18
6059 funds, or both available to it, for the purpose of supplementing the State 19
6160 Treasury funds for financing the entire costs of the project or projects 20
6261 enumerated herein. Provided further, that the appropriations and funds 21
6362 otherwise provided by the General Assembly for Maintenance and General 22
6463 Operations of the agency or institutions receiving appropriation herein shall 23
6564 not be used for any of the purposes as appropriated in this act. 24
6665 (B) The restrictions of any applicable provisions of the State 25
6766 Purchasing Law, the General Accounting and Budgetary Procedures Law, the 26
6867 Revenue Stabilization Law and any other applicable fiscal control laws of 27
6968 this State and regulations promulgated by the Department of Finance and 28
7069 Administration, as authorized by law, shall be strictly complied with in 29
7170 disbursement of any funds provided by this act unless specifically provided 30
7271 otherwise by law. 31

7473 SECTION 5. LEGISLATIVE INTENT. It is the intent of the General 33
7574 Assembly that any funds disbursed under the authority of the appropriations 34
7675 contained in this act shall be in compliance with the stated reasons for 35
7776 which this act was adopted, as evidenced by the Agency Requests, Executive 36 SB336

8079 Recommendations and Legislative Recommendations contained in the budget 1
8180 manuals prepared by the Department of Finance and Administration, letters, or 2
8281 summarized oral testimony in the official minutes of the Arkansas Legislative 3
8382 Council or Joint Budget Committee which relate to its passage and adoption. 4

8584 SECTION 6. EMERGENCY CLAUSE. It is found and determined by the General 6
8685 Assembly, that the Constitution of the State of Arkansas prohibits the 7
8786 appropriation of funds for more than a one (1) year period; that the 8
8887 effectiveness of this Act on July 1, 2025 is essential to the operation of 9
8988 the agency for which the appropriations in this Act are provided, and that in 10
9089 the event of an extension of the legislative session, the delay in the 11
9190 effective date of this Act beyond July 1, 2025 could work irreparable harm 12
9291 upon the proper administration and provision of essential governmental 13
9392 programs. Therefore, an emergency is hereby declared to exist and this Act 14
9493 being necessary for the immediate preservation of the public peace, health 15
9594 and safety shall be in full force and effect from and after July 1, 2025. 16
