22	21		BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 19

24	23		SECTION 1. APPROPRIATION - CAPITAL IMPROVEMENT PROJECTS . There is 21
25	24		hereby appropriated, to the Department of Health , to be payable from the 22
26	25		federal funds as designated by the Chief Fiscal Officer of the State , the 23
27	26		following: 24
28	27		(A) for steam plant conversion at the Main Campus , in a sum not to 25
29	28		exceed ........................................................... $6,992,700. 26
30	29		(B) for replacement of the generator at the Public Health Lab , in a sum 27
31	30		not to exceed ...................................................... $820,000. 28

33	32		SECTION 2. APPROPRIATION - CAPITAL IMPROVEMENT PROJECTS . There is 30
34	33		hereby appropriated, to the Department of Health , to be payable from the cash 31
35	34		fund deposited in the State Treasury as determined by the Chief Fiscal 32
36	35		Officer of the State , the following: 33
37	36		(A) for replacement of the Arkansas Department of Health main facility , 34
38	37		in a sum not to exceed ......................................... $114,000,000. 35

42	41		SECTION 3. APPROPRIATION - CAPITAL IMPROVEMENT PROJECTS . There is 1
43	42		hereby appropriated, to the Department of Health , to be payable from the 2
44	43		paying account as determined by the Chief Fiscal Officer of the State , the 3
45	44		following: 4
46	45		(A) for Freeway Suite 305 , in a sum not to exceed ............ $505,330. 5
47	46		(B) for surface parking repair and renovation at the Main Campus , in a 6
48	47		sum not to exceed .................................................. $594,651. 7
49	48		(C) for switchboard modifications at the Main Public Health Lab , in a 8
50	49		sum not to exceed .................................................. $250,000. 9
51	50		(D) for replacement of the Arkansas Department of Health main facility , 10
52	51		in a sum not to exceed .......................................... $30,031,020. 11

54	53		SECTION 4. DISBURSEMENT CONTROLS. (A) No contract may be awarded nor 13
55	54		obligations otherwise incurred in relation to the project or projects 14
56	55		described herein in excess of the State Treasury funds actually available 15
57	56		therefor as provided by law. Provided, however, that institutions and 16
58	57		agencies listed herein shall have the authority to accept and use grants and 17
59	58		donations including Federal funds, and to use its unobligated cash income or 18
60	59		funds, or both available to it, for the purpose of supplementing the State 19
61	60		Treasury funds for financing the entire costs of the project or projects 20
62	61		enumerated herein. Provided further, that the appropriations and funds 21
63	62		otherwise provided by the General Assembly for Maintenance and General 22
64	63		Operations of the agency or institutions receiving appropriation herein shall 23
65	64		not be used for any of the purposes as appropriated in this act. 24
66	65		(B) The restrictions of any applicable provisions of the State 25
67	66		Purchasing Law, the General Accounting and Budgetary Procedures Law, the 26
68	67		Revenue Stabilization Law and any other applicable fiscal control laws of 27
69	68		this State and regulations promulgated by the Department of Finance and 28
70	69		Administration, as authorized by law, shall be strictly complied with in 29
71	70		disbursement of any funds provided by this act unless specifically provided 30
72	71		otherwise by law. 31

74	73		SECTION 5. LEGISLATIVE INTENT. It is the intent of the General 33
75	74		Assembly that any funds disbursed under the authority of the appropriations 34
76	75		contained in this act shall be in compliance with the stated reasons for 35
77	76		which this act was adopted, as evidenced by the Agency Requests, Executive 36 SB336

80	79		Recommendations and Legislative Recommendations contained in the budget 1
81	80		manuals prepared by the Department of Finance and Administration, letters, or 2
82	81		summarized oral testimony in the official minutes of the Arkansas Legislative 3
83	82		Council or Joint Budget Committee which relate to its passage and adoption. 4

85	84		SECTION 6. EMERGENCY CLAUSE. It is found and determined by the General 6
86	85		Assembly, that the Constitution of the State of Arkansas prohibits the 7
87	86		appropriation of funds for more than a one (1) year period; that the 8
88	87		effectiveness of this Act on July 1, 2025 is essential to the operation of 9
89	88		the agency for which the appropriations in this Act are provided, and that in 10
90	89		the event of an extension of the legislative session, the delay in the 11
91	90		effective date of this Act beyond July 1, 2025 could work irreparable harm 12
92	91		upon the proper administration and provision of essential governmental 13
93	92		programs. Therefore, an emergency is hereby declared to exist and this Act 14
94	93		being necessary for the immediate preservation of the public peace, health 15
95	94		and safety shall be in full force and effect from and after July 1, 2025. 16
