APPROPRIATION - STAFF SERVICES. APPROPRIATION - REAPPROPRIATION - CONSTITUTIONAL OFFICERS 3 FUND. There is hereby appropriated, to the Arkansas Senate, to be payable 4 from the Constitutional Officers Fund , for the balance remaining on June 30, 5 2025 in the appropriations Section 3 of Act 1 of 2024, Sections 4 and 5 of 6 Act 32 of 2024, and SB1 as introduced in the 2025 Regular Session, there to 7 be used for any purpose to defray the necessary expenses of the Arkansas 8 Senate of the Ninety -Fifth General Assembly, in a sum in the aggregate not to 9 exceed............................................................ $4,000,000. 10 11 SECTION 6. APPROPRIATION - REAPPROPRIATION - STATE CENTRAL SERVICES 12 FUND. There is hereby appropriated, to the Arkansas Senate, to be payable 13 from the State Central Services Fund , and payable from the balance remaining 14 on June 30, 2025 in the appropriations, Sections 3, 6, 7 and 8 of Act 32 of 15 2024 there to be used for any purpose to defray the necessary expenses of the 16 Arkansas Senate of the Ninety -Fifth General Assembly, in a sum in the 17 aggregate not to exceed........................................... $4,000,000. 18 19 SECTION 7. APPROPRIATION - COMPUTERIZATION. There is hereby 20 appropriated, to the Arkansas Senate, to be payable from the State Central 21 Services Fund, for expenses necessary in continuing the computerization of 22 the legislative process in the Arkansas Senate , the sum of.......... $700,000. 23 24 SECTION 8. APPROPRIATION - RENOVATIONS AND IMPROVEMENTS . There is 25 hereby appropriated, to the Arkansas Senate, to be payable from the State 26 Central Services Fund , for construction, improvements, renovations and 27 equipping of the Arkansas Senate facilities and other purposes of the 28 Arkansas Senate, the sum of......................................... $700,000. 29 30 SECTION 9. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 31 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. 32 TRANSFERS. If the Senate Efficiency Committee and the Secretary of the 33 Senate, subject to the approval of the Arkansas Senate, should determine that 34 any item or portion thereof appropriated herein for a specific purpose is not 35 needed for such purpose, the Secretary of the Senate may certify such fact to 36 SB346 4 02/27/2025 10:40:26 AM JAR008 the State Auditor and the State Auditor shall cause a transfer to be made 1 from one item to another. 2 3 SECTION 10. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 4 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. SALARIES. 5 In order that exceptionally well -qualified personnel may be recruited and 6 retained, the Senate may exceed the maximum salary levels by no more than 7 twenty percent (20%) for no more than one -third (1/3) of the positions 8 authorized in their operation appropriation act, and may exceed the maximum 9 salary levels for the purpose of merit adjustments for all positions. 10 11 SECTION 11. COMPLIANCE WITH OTHER LAWS. Disbursement of funds 12 authorized by this act shall be limited to the appropriation for such agency 13 and funds made available by law for the support of such appropriations; and 14 the restrictions of the State Procurement Law, the General Accounting and 15 Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary 16 Procedures and Restrictions Act, or their successors, and other fiscal 17 control laws of this State, where applicable, and regulations promulgated by 18 the Department of Finance and Administration, as authorized by law, shall be 19 strictly complied with in disbursement of said funds. 20 21 SECTION 12. LEGISLATIVE INTENT. It is the intent of the General 22 Assembly that any funds disbursed under the authority of the appropriations 23 contained in this act shall be in compliance with the stated reasons for 24 which this act was adopted, as evidenced by the Agency Requests, Executive 25 Recommendations and Legislative Recommendations contained in the budget 26 manuals prepared by the Department of Finance and Administration, letters, or 27 summarized oral testimony in the official minutes of the Arkansas Legislative 28 Council or Joint Budget Committee which relate to its passage and adoption. 29 30 SECTION 13. EMERGENCY CLAUSE. It is found and determined by the 31 General Assembly, that the Constitution of the State of Arkansas prohibits 32 the appropriation of funds for more than a one (1) year period; that the 33 effectiveness of this Act on July 1, 2025 is essential to the operation of 34 the agency for which the appropriations in this Act are provided, and that in 35 the event of an extension of the legislative session, the delay in the 36 SB346 5 02/27/2025 10:40:26 AM JAR008 effective date of this Act beyond July 1, 2025 could work irreparable harm 1 upon the proper administration and provision of essential governmental 2 programs.
