27	25		BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 23

29	27		SECTION 1. Arkansas Code § 19 -5-1217 is repealed. 25
30	28		19-5-1217. Computer and Electronic Recycling Fund. 26
31	29		(a) There is established on the books of the Treasurer of State, the 27
32	30		Auditor of State, and the Chief Fiscal Officer of the State a fund to be 28
33	31		known as the “Computer and Electronic Recycling Fund”. 29
34	32		(b) The fund shall be administered by the Division of Environmental 30
35	33		Quality and may be used to: 31
36	34		(1) Promote market research and development grants to determine 32
37	35		the most efficient means of collecting, transporting, and processing scrap 33
38	36		electronic equipment; 34
39	37		(2) Work with the Department of Finance and Administration and 35

46	42		(3) Support and fund other measures necessary to implement and 2
47	43		promote the recycling, donation, demanufacturing, or disposal options for 3
48	44		computers and electronic equipment. 4

50	46		SECTION 2. Arkansas Code § 25 -34-108 is amended to read as follows: 6
51	47		25-34-108. Disbursement of revenues. 7
52	48		Funds generated from the sale of agency surplus computer and electronic 8
53	49		equipment to state employees, public schools, or by other sale shall be 9
54	50		allocated as follows: 10
55	51		(1) If the sale of surplus computer or electronic equipment is 11
56	52		made within the agency: 12
57	53		(A) Sixty percent (60%) of the proceeds shall be returned 13
58	54		to the owning agency; and 14
59	55		(B) Fifteen percent (15%) Forty percent (40%) of the 15
60	56		proceeds shall be deposited with the Marketing and Redistribution Section; 16
61	57		and 17
62	58		(C) Twenty-five percent (25%) of the proceeds shall be 18
63	59		deposited into the Computer and Electronic Recycling Fund established by this 19
64	60		chapter; and 20
65	61		(2) If the sale of surplus computer or electronic equipment is 21
66	62		outside the agency and conducted by the Marketing and Redistribution Section: 22
67	63		(A) Fifty percent (50%) of the proceeds shall be returned 23
68	64		to the owning agency; and 24
69	65		(B) Twenty-five percent (25%) Fifty percent (50%) of the 25
70	66		proceeds shall be deposited with the Marketing and Redistribution Section ; 26

72	68		(C) Twenty-five percent (25%) of the proceeds shall be 28
73	69		deposited into the fund established by this chapter and § 19 -5-1217. 29

75	71		SECTION 3. Arkansas Code §§ 25 -34-109 and 25-34-110 are repealed. 31

97	91		(a) Electronic equipment recycling grants must be awarded on the basis 13
98	92		of written grant-request proposals submitted to and approved by the Division 14
99	93		of Environmental Quality. 15
100	94		(b) Grant requests shall be considered based upon the following 16
101	95		criteria: 17
102	96		(1) The development of sustained processes for recovery, 18
103	97		recycling, and demanufacturing of scrap computers and electronics; 19
104	98		(2) Minimization and elimination of substantial volumes of this 20
105	99		material as waste; 21
106	100		(3) Creation of Arkansas jobs; 22
107	101		(4) Return of investment analysis; and 23
108	102		(5) Available funds. 24

	104	+	SECTION 4. EMERGENCY CLAUSE. It is found and determined by the 26
	105	+	General Assembly of the State of Arkansas that the this act is essential to 27
	106	+	prudent operation of the Division of Environmental Quality; that delay in the 28
	107	+	effective date could do irreparable harm to the proper administration of 29
	108	+	government programs of the division; and that this act is immediately 30
	109	+	necessary as it is essential to the prudent operation of the Division of 31
	110	+	Environmental Quality and delay in the effective date could work irreparable 32
	111	+	harm on the proper administration of government programs of the division. 33
	112	+	Therefore, an emergency is declared to exist, and this act being immediately 34
	113	+	necessary for the preservation of the public peace, health, and safety shall 35

	117	+	(1) The date of its approval by the Governor; 1
	118	+	(2) If the bill is neither approved nor vetoed by the Governor, 2
