2725 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 23

2927 SECTION 1. Arkansas Code § 19 -5-1217 is repealed. 25
3028 19-5-1217. Computer and Electronic Recycling Fund. 26
3129 (a) There is established on the books of the Treasurer of State, the 27
3230 Auditor of State, and the Chief Fiscal Officer of the State a fund to be 28
3331 known as the “Computer and Electronic Recycling Fund”. 29
3432 (b) The fund shall be administered by the Division of Environmental 30
3533 Quality and may be used to: 31
3634 (1) Promote market research and development grants to determine 32
3735 the most efficient means of collecting, transporting, and processing scrap 33
3836 electronic equipment; 34
3937 (2) Work with the Department of Finance and Administration and 35

4743 promote the recycling, donation, demanufacturing, or disposal options for 3

5046 SECTION 2. Arkansas Code § 25 -34-108 is amended to read as follows: 6
5147 25-34-108. Disbursement of revenues. 7
5248 Funds generated from the sale of agency surplus computer and electronic 8
5349 equipment to state employees, public schools, or by other sale shall be 9
5450 allocated as follows: 10
5551 (1) If the sale of surplus computer or electronic equipment is 11
5652 made within the agency: 12
5753 (A) Sixty percent (60%) of the proceeds shall be returned 13
5854 to the owning agency; and 14
5955 (B) Fifteen percent (15%) Forty percent (40%) of the 15
6056 proceeds shall be deposited with the Marketing and Redistribution Section; 16

6258 (C) Twenty-five percent (25%) of the proceeds shall be 18
6359 deposited into the Computer and Electronic Recycling Fund established by this 19
6460 chapter; and 20
6561 (2) If the sale of surplus computer or electronic equipment is 21
6662 outside the agency and conducted by the Marketing and Redistribution Section: 22
6763 (A) Fifty percent (50%) of the proceeds shall be returned 23

6965 (B) Twenty-five percent (25%) Fifty percent (50%) of the 25

9791 (a) Electronic equipment recycling grants must be awarded on the basis 13
9892 of written grant-request proposals submitted to and approved by the Division 14

10094 (b) Grant requests shall be considered based upon the following 16
10195 criteria: 17
10296 (1) The development of sustained processes for recovery, 18
10397 recycling, and demanufacturing of scrap computers and electronics; 19
10498 (2) Minimization and elimination of substantial volumes of this 20
10599 material as waste; 21
106100 (3) Creation of Arkansas jobs; 22
107101 (4) Return of investment analysis; and 23
108102 (5) Available funds. 24

104+ SECTION 4. EMERGENCY CLAUSE. It is found and determined by the 26
105+General Assembly of the State of Arkansas that the this act is essential to 27
106+prudent operation of the Division of Environmental Quality; that delay in the 28
107+effective date could do irreparable harm to the proper administration of 29
108+government programs of the division; and that this act is immediately 30
109+necessary as it is essential to the prudent operation of the Division of 31
110+Environmental Quality and delay in the effective date could work irreparable 32
111+harm on the proper administration of government programs of the division. 33
112+Therefore, an emergency is declared to exist, and this act being immediately 34
113+necessary for the preservation of the public peace, health, and safety shall 35
