24	24	BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 22

26	26	SECTION 1. Arkansas Code § 6 -18-1904(f)(1), concerning the 24
27	27	participation in an extracurricular activity of a student who transfers to 25
28	28	another public school or a nonresident district under the Public School 26
29	29	Choice Act of 2015, is amended to read as follows: 27
30	30	(f)(1)(A) A student who transfers to another public school or a 28
31	31	nonresident district under this subchapter shall not be: 29
32	32	(A)(i) Denied participation in an extracurricular 30
33	33	activity at the public school or nonresident district to which he or she 31
34	34	transfers based exclusively on his or her decision to transfer to the public 32
35	35	school or nonresident district; or 33
36	36	(B)(ii) Disciplined in any manner based exclusively 34
37	37	on the exercise of his or her right to transfer to another public school or a 35
38	38	nonresident district under this subchapter. 36 SB436

41	41	(B) However, a student who transfers to another public 1
42	42	school or a nonresident district under this subchapter for two (2) 2
43	43	consecutive years may be prohibited by the public school or nonresident 3
44	44	district to which he or she transfers from participating in an 4
45	45	extracurricular activity at the public school or nonresident district for a 5
46	46	period of three hundred sixty -five (365) days. 6
