21	21	BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 19

23	23	SECTION 1. Arkansas Code Title 5, Chapter 60, Subchapter 1, is amended 21
24	24	to add an additional section to read as follows: 22
25	25	5-60-126. Purchase or possession of an e -liquid or a vapor product by 23
26	26	a minor. 24
27	27	(a) As used in this section: 25
28	28	(1) "E-liquid product" means a liquid, which may contain 26
29	29	nicotine, that is inhaled when using a vapor product, and that may include 27
30	30	without limitation propylene glycol, vegetable glycerin, nicotine from any 28
31	31	source, and flavorings; 29
32	32	(2)(A) "Minor" means a person who is under twenty -one (21) years 30
33	33	of age. 31
34	34	(B) "Minor" does not include a person who is under twenty -32
35	35	one years of age and presents a military identification card establishing 33
36	36	that he or she is a member of the United States Armed Forces; and 34
37	37	(3)(A) "Vapor product" means an electronic oral device of any 35
38	38	size or shape that contains a vapor of nicotine, e -liquid product, or any 36 SB472

41	41	other substance that when used or inhaled simulates smoking, regardless of 1
42	42	whether a visible vapor is produced, including without limitation a device 2
43	43	that: 3
44	44	(i) Is composed of a heating element, battery, 4
45	45	electronic circuit, chemical process, mechanical device, or a combination of 5
46	46	a heating element, a battery, an electronic circuit, a chemical process, or a 6
47	47	mechanical device; 7
48	48	(ii) Works in combination with a cartridge, other 8
49	49	container, or liquid delivery device containing nicotine, an e -liquid 9
50	50	product, or another substance that is manufactured for use with a vapor 10
51	51	product; and 11
52	52	(iii) Is manufactured, distributed, marketed, or 12
53	53	sold as any type or derivation of a vapor product, an e -cigarette, an e-13
54	54	cigar, an e-pipe, or another product that is similar to a vapor product. 14
55	55	(B) "Vapor product" does not include a product regulated 15
56	56	as a drug or device by the Federal Food, Drug, and Cosmetic Act, 21 U.S.C. § 16
57	57	301 et seq., as it existed on January 1, 2025. 17
58	58	(b) It is unlawful for a minor to purchase or possess an e -liquid 18
59	59	product or a vapor product. 19
60	60	(c) An officer that seizes an e -liquid product or a vapor product 20
61	61	found in the possession of a minor shall destroy the item or dispose of the 21
62	62	item as contraband under § 5 -5-101. 22
63	63	(d) Purchase or possession of an e -liquid product or a vapor product 23
64	64	by a minor is a violation and is punishable by a fine not to exceed one 24
65	65	hundred dollars ($100) or up to twenty (20) hours of community service work, 25
66	66	or both. 26
