2121 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 19

2323 SECTION 1. Arkansas Code Title 5, Chapter 60, Subchapter 1, is amended 21
2424 to add an additional section to read as follows: 22
2525 5-60-126. Purchase or possession of an e -liquid or a vapor product by 23
2626 a minor. 24
2727 (a) As used in this section: 25
2828 (1) "E-liquid product" means a liquid, which may contain 26
2929 nicotine, that is inhaled when using a vapor product, and that may include 27
3030 without limitation propylene glycol, vegetable glycerin, nicotine from any 28
3131 source, and flavorings; 29
3232 (2)(A) "Minor" means a person who is under twenty -one (21) years 30
3333 of age. 31
3434 (B) "Minor" does not include a person who is under twenty -32
3535 one years of age and presents a military identification card establishing 33
3636 that he or she is a member of the United States Armed Forces; and 34
3737 (3)(A) "Vapor product" means an electronic oral device of any 35
3838 size or shape that contains a vapor of nicotine, e -liquid product, or any 36 SB472

4141 other substance that when used or inhaled simulates smoking, regardless of 1
4242 whether a visible vapor is produced, including without limitation a device 2
4343 that: 3
4444 (i) Is composed of a heating element, battery, 4
4545 electronic circuit, chemical process, mechanical device, or a combination of 5
4646 a heating element, a battery, an electronic circuit, a chemical process, or a 6
4747 mechanical device; 7
4848 (ii) Works in combination with a cartridge, other 8
4949 container, or liquid delivery device containing nicotine, an e -liquid 9
5050 product, or another substance that is manufactured for use with a vapor 10
5151 product; and 11
5252 (iii) Is manufactured, distributed, marketed, or 12
5353 sold as any type or derivation of a vapor product, an e -cigarette, an e-13
5454 cigar, an e-pipe, or another product that is similar to a vapor product. 14
5555 (B) "Vapor product" does not include a product regulated 15
5656 as a drug or device by the Federal Food, Drug, and Cosmetic Act, 21 U.S.C. § 16
5757 301 et seq., as it existed on January 1, 2025. 17
5858 (b) It is unlawful for a minor to purchase or possess an e -liquid 18
5959 product or a vapor product. 19
6060 (c) An officer that seizes an e -liquid product or a vapor product 20
6161 found in the possession of a minor shall destroy the item or dispose of the 21
6262 item as contraband under § 5 -5-101. 22
6363 (d) Purchase or possession of an e -liquid product or a vapor product 23
6464 by a minor is a violation and is punishable by a fine not to exceed one 24
6565 hundred dollars ($100) or up to twenty (20) hours of community service work, 25
6666 or both. 26
