19	19	BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 17

21	21	SECTION 1. Arkansas Code Title 2, Chapter 33, Subchapter 3, is amended 19
22	22	to add an additional section to read as follows: 20
23	23	2-33-309. State Action Poultry Flock Depopulation Grant Program. 21
24	24	(a) There is established within the Department of Finance and 22
25	25	Administration the State Action Poultry Flock Depopulation Grant Program to 23
26	26	be administered by the Secretary of the Department of Finance and 24
27	27	Administration. 25
28	28	(b) The secretary shall award grants under the program to provide 26
29	29	financial assistance to eligible poultry growers within the state. 27
30	30	(c)(1) A poultry grower whose poultry flock was depopulated by the 28
31	31	state is eligible to receive grant funds under this section. 29
32	32	(2) Subdivision (c)(1) of this section includes without 30
33	33	limitation a poultry grower whose poultry flock was depopulated by the state 31
34	34	prior to the effective date of this act. 32
35	35	(d)(1) The department shall promulgate rules to implement this 33
36	36	section. 34
37	37	(2) The rules promulgated under subdivision (d)(1) of this 35
38	38	section shall include without limitation the process for: 36 SB582

41	41	(A) Submitting documentation to the department showing a 1
42	42	poultry grower's loss due to state -mandated depopulation of the poultry 2
43	43	grower's poultry flock; and 3
44	44	(B) Distribution of grant funds. 4

46	46	SECTION 2. DO NOT CODIFY. Rules. 6
47	47	(a) When adopting the initial rules required under this act, the 7
48	48	Department of Finance and Administration shall file the final rules with the 8
49	49	Secretary of State for adoption under § 25 -15-204(f): 9
50	50	(1) On or before January 1, 2026; or 10
51	51	(2) If approval under § 10 -3-309 has not occurred by January 1, 11
52	52	2026, as soon as practicable after approval under § 10 -3-309. 12
53	53	(b) The department shall file the proposed rules with the Legislative 13
54	54	Council under § 10-3-309(c) sufficiently in advance of January 1, 2026, so 14
55	55	that the Legislative Council may consider the rules for approval before 15
56	56	January 1, 2026. 16
