AN ACT TO AMEND THE LAW CONCERNING THE CAPITOL ZONING 9 
DISTRICT; TO AMEND THE ZONING AUTHORITY OF THE 10 
CAPITOL ZONING DISTRICT COMMISSION; AND FOR OTHER 11 
PURPOSES. 12

TO AMEND THE LAW CONCERNING THE CAPITOL 16 
ZONING DISTRICT; AND TO AMEND THE ZONING 17 
AUTHORITY OF THE CAPITOL ZONING DISTRICT 18 
COMMISSION. 19

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 21 
 22 
 SECTION 1.  Arkansas Code § 22 -3-302, concerning the purpose and 23 
creation of the Capitol Zoning District, is amended to add an additional 24 
subsection to read as follows: 25 
 (c)(1)  Except as provided under subdivision (c)(2) of this section, in 26 
addition to the areas described under subsections (a) and (b) of this 27 
section, the Capitol Zoning District shall also include all streets, paths, 28 
bike lanes, and rights -of-way within a one-mile radius of the State Capitol. 29 
 (2)  The streets, paths, bike lanes, and rights -of-way under 30 
subdivision (c)(1) of this section shall not include those state highways as 31 
designated under § 27 -67-201. 32

 SECTION 2.  Arkansas Code § 22 -3-304 is amended to read as follows: 34 
 22-3-304.  Zoning authority of Capitol Zoning District Commission. 35 
 The Capitol Zoning District Commission is authorized broad scope in its 36    	SB617

zoning authority to include , but not be limited to, without limitation the 1 
following: 2 
 (1)  Restrictions on the height, number of stories, and size of 3 
buildings; 4 
 (2)  Percentage of lots that may be occupied; 5 
 (3)  Use of structures and land; 6 
 (4)  Population density; 7 
 (5)  Amount of open space; 8 
 (6)  Parking areas; and 9 
 (7)  Restriction of noisy and polluting processes or those 10 
endangering the health and safety of the citizens of the zoning district	; and 11 
 (8)  Design of streets, paths, bike lanes, and rights -of-way, 12 
except those state highways as designated under § 27 -67-201, within a one-13 
mile radius of the State Capitol . 14
