2322 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 20

2524 SECTION 1. Arkansas Code Title 20, Chapter 56, Subchapter 2, is 22
2625 amended to add an additional section to read as follows: 23
2726 20-56-224. Labeling of hair relaxers — Legislative findings — 24
2827 Definitions. 25
2928 (a) The General Assembly finds that certain chemicals used in hair 26
3029 relaxers are linked to harmful impacts on health, such as cancer, birth 27
3130 defects, damage to the reproductive system, organ system toxicity, and 28
3231 endocrine disruption. 29
3332 (b) As used in this section: 30
3433 (1) Carcinogen" means any chemical identified as: 31
3534 (A) A "Group 1 carcinogen" or "Group 2A carcinogen" by the 32
3635 World Health Organization or International Agency for Research on Cancer; 33
3736 (B) A "known to be a human carcinogen" and "reasonably 34
3837 anticipated to be a human carcinogen" by the Secretary of the United States 35

4241 42 U.S.C. § 241(b)(4), existing on January 1, 2025; and 1
4342 (C) "Group A carcinogens" or "Group B carcinogens" by the 2
4443 United States Environmental Protection Agency; 3
4544 (2) “Hair relaxer” means any product topically applied to hair 4
4645 for the purpose of weakening the structure and curliness of the hair fiber 5
4746 and allowing for a straightening of the hair; and 6
4847 (3) "Reproductive toxicant" means any chemical identified as a 7
4948 reproductive or a developmental toxicant by the United States Department of 8
5049 Health and Human Services, National Toxicology Program, Center for the 9
5150 Evaluation of Risks to Human Reproduction. 10
5251 (c)(1) A hair relaxer being offered for sale in this state that 11
5352 contains a carcinogen or a reproductive toxicant shall provide a clear and 12
5453 conspicuous warning label displayed on the packaging or product itself, which 13
5554 shall be printed in type no less than size twelve -point font, that notifies 14
5655 the consumer at the time of the sale that the hair relaxer contains a 15
5756 carcinogen or reproductive toxicant. 16
5857 (2) The warning label shall state: 17
5958 (A) If a product contains a carcinogen: "This product 18
6059 contains a chemical known to cause cancer"; 19
6160 (B) If a product contains a reproductive toxicant: "This 20
6261 product contains a chemical known to cause birth defects or other 21
6362 reproductive harm"; or 22
6463 (C) If a product contains both a carcinogen and a 23
6564 reproductive toxicant: "This product contains chemicals known to cause cancer 24
6665 and birth defects or other reproductive harm". 25
