299298 ending June 30, 2025, the Chief Fiscal Officer of the State shall authorize 30
300299 up to $50,000 of the balance of funds remaining in the Miscellaneous Agencies 31
301300 Fund Account for the Department of Veterans Affairs for operations to be 32
302301 transferred into a sub -fund created within the Miscellaneous Agencies Fund 33

308307 Any carry forward of unexpended balance of funding as authorized herein, may 1
309308 be carried forward under the following conditions: 2
310309 (1) Prior to June 30, 2025 the Agency shall by written statement set forth 3
311310 its reason(s) for the need to carry forward said funding to the Department 4
312311 of Finance and Administration Office of Budget; 5
313312 (2) The Department of Finance and Administration Office of Budget shall 6
314313 report to the Arkansas Legislative Council all amounts carried forward by the 7
315314 September Arkansas Legislative Council or Joint Budget Committee meeting 8
316315 which report shall include the name of the Agency, Board, Commission or 9
317316 Institution and the amount of the funding carried forward from the first 10
318317 fiscal year to the second fiscal year, the program name or line item, the 11
319318 funding source of that appropriation and a copy of the written request set 12
320319 forth in (1) above; 13
321320 (3) Each Agency, Board, Commission or Institution shall provide a written 14
322321 report to the Arkansas Legislative Council or Joint Budget Committee 15
323322 containing all information set forth in item (2) above, along with a written 16
324323 statement as to the current status of the project, contract, purpose etc. for 17
325324 which the carry forward was originally requested no later than thirty (30) 18
326325 days prior to the time the Agency, Board, Commission or Institution presents 19
327326 its budget request to the Arkansas Legislative Council/Joint Budget 20
328327 Committee; and 21
329328 (4) Thereupon, the Department of Finance and Administration shall include 22
330329 all information obtained in item (3) above in the budget manuals and/or a 23
331330 statement of non-compliance by the Agency, Board, Commission or Institution. 24
332331 The provisions of this section shall be in effect only from July 1, 2025 25
333332 through June 30, 2026. 26

335334 SECTION 15. COMPLIANCE WITH OTHER LAWS. Disbursement of funds 28
336335 authorized by this act shall be limited to the appropriation for such agency 29
337336 and funds made available by law for the support of such appropriations; and 30
338337 the restrictions of the State Procurement Law, the General Accounting and 31
339338 Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary 32
340339 Procedures and Restrictions Act, or their successors, and other fiscal 33
341340 control laws of this State, where applicable, and regulations promulgated by 34
342341 the Department of Finance and Administration, as authorized by law, shall be 35
343342 strictly complied with in disbursement of said funds. 36 SB74

347346 SECTION 16. LEGISLATIVE INTENT. It is the intent of the General 2
348347 Assembly that any funds disbursed under the authority of the appropriations 3
349348 contained in this act shall be in compliance with the stated reasons for 4
350349 which this act was adopted, as evidenced by the Agency Requests, Executive 5
351350 Recommendations and Legislative Recommendations contained in the budget 6
352351 manuals prepared by the Department of Finance and Administration, letters, or 7
353352 summarized oral testimony in the official minutes of the Arkansas Legislative 8
354353 Council or Joint Budget Committee which relate to its passage and adoption. 9

356355 SECTION 17. EMERGENCY CLAUSE. It is found and determined by the 11
357356 General Assembly, that the Constitution of the State of Arkansas prohibits 12
358357 the appropriation of funds for more than a one (1) year period; that the 13
359358 effectiveness of this Act on July 1, 2025 is essential to the operation of 14
360359 the agency for which the appropriations in this Act are provided, and that in 15
361360 the event of an extension of the legislative session, the delay in the 16
362361 effective date of this Act beyond July 1, 2025 could work irreparable harm 17
363362 upon the proper administration and provision of essential governmental 18
364363 programs. Therefore, an emergency is hereby declared to exist and this Act 19
365364 being necessary for the immediate preservation of the public peace, health 20
366365 and safety shall be in full force and effect from and after July 1, 2025. 21
