BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 24

 SECTION 1. REGULAR SALARIES - ARKANSAS SCHOOL FOR THE BLIND .  There is 26 
hereby established for the Department of Education - Arkansas School for the 27 
Blind for the 2025-2026 fiscal year, the following maximum number of regular 28

for the 2025-2026 fiscal year, the following maximum number of part -time or 29 
temporary employees, to be known as "Extra Help", payable from funds 30 
appropriated herein for such purposes: seventeen (17) temporary or part-time 31 
employees, when needed, at rates of pay not to exceed those provided in the 32 
Uniform Classification and Compensation Act, or its successor, or this act 33

 SECTION 12. SPECIAL LANGUAGE.  NOT TO BE INCORPORATED INTO THE ARKANSAS 19

ARKANSAS SCHOOL FOR THE BLIND - TRANSFER PROVISION.  Upon approval from the 21 
Chief Fiscal Officer of the State, the Arkansas School for the Blind shall 22 
transfer appropriation from the Summer Projects line item, in the State 23 
Operations Appropriation of this Act, to the Regular Salaries, Extra Help, 24 
Personal Services Matching, Overtime and Maintenance & General Operations 25 
line items in the State Operations Appropriation of this Act, to compensate 26 
staff who work during the summer months on summer projects, and to cover 27 
other expenses of summer project activities.  The Summer Projects line item 28 
may also be used for the annual cost related to the compensation of eligible 29 
staff for shift differential pay as well as compensation of employees for 30 
performance of duties assigned as referenced in the Special Allowance Special 31 
Language Section of this Act. Such additional compensation shall not be 32 
construed as exceeding the maximum salary authorized for said employees. 33 
   The provisions of this section shall be in effect only from July 1, 	2024 34 
2025 through June 30, 2025 2026. 35

 SECTION 13. SPECIAL LANGUAGE.  NOT TO BE INCORPORATED INTO THE ARKANSAS 1 
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW.   2 
ADE - ASB/ASD - SUMMER SCHOOL EMPLOYEES.  Employees who, in addition to 3 
working during the regular school term, also work during summer months shall 4 
be authorized as additional compensation an amount not to exceed 1/12 of 5 
their annual salary for each month or part thereof worked.  Such additional 6 
compensation shall not be construed as exceeding the maximum salary 7 
authorized for said employees.  Payment of additional compensation shall be 8 
limited to employees in the following classifications: 9

  Exempt employees who require job responsibilities less than 2080 hours may 21 
work during summer months with approval from school Superintendent.  Said 22 
employees shall be authorized as additional compensation an amount not to 23 
exceed 1/12 of their annual salary for each month or part thereof worked.  24 
Such additional compensation shall not be construed as exceeding the maximum 25 
salary authorized for said employees. 26 
  The provisions of this section shall be in effect only from July 1, 	2024 27 
2025 through June 30, 2025 2026. 28

 SECTION 14. SPECIAL LANGUAGE.  NOT TO BE INCORPORATED INTO THE ARKANSAS 30 
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW.   31 
CARRY FORWARD OF FUNDS - ASB. 32 
 (a)  The Chief Fiscal Officer of the State shall cause to be 33 
transferred on his or her books and those of the State Treasurer and Auditor 34 
of State the balance of General Revenue funds remaining in the School for the 35 
Blind Fund Account on June 30, 2024 2025 into a sub-fund created within the 36    	SB75

School for the Blind Fund Account to be used for special maintenance, 1 
renovations, or future construction projects of the Department of Education 	- 2 
Arkansas School for the Blind. 3 
 (b)  Any carry forward of the unexpended balance of funding as 4 
authorized herein, may be carried forward under the following conditions: 5 
 (1)  The Office of Budget of the Department of Finance and 6 
Administration shall report to the Legislative Council all amounts carried 7 
forward by the September meeting of the Legislative Council or the Joint 8 
Budget Committee meeting which report shall include the name of the agency, 9 
board, commission, or institution and the amount of funding carried forward, 10 
the program name or line item and the funding source; and 11 
 (2) The Department of Education - Arkansas School for the Blind 12 
shall provide a written report to the Legislative Council or Joint Budget 13 
Committee containing all information set forth in subdivision (b)(1) of this 14 
section no later than thirty (30) days prior to the time the Department 15 
presents its budget request to the Legislative Council or Joint Budget 16 
Committee, or both; and 17 
 (3) Thereupon, the Department of Finance and Administration shall 18 
include all information obtained in subdivision (b)(2) of this section in the 19 
budget manuals. 20 
 The provisions of this section shall be in effect only from July 1, 21 
2024 2025 through June 30, 2025 2026. 22 
 23 
 SECTION 15. SPECIAL LANGUAGE.  NOT TO BE INCORPORATED INTO THE ARKANSAS 24 
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. 25 
ARKANSAS SCHOOL FOR THE DEAF - TRANSFER PROVISION.  Upon approval from the 26 
Chief Fiscal Officer of the State, the Arkansas School for the Deaf shall 27 
transfer appropriation from the Miscellaneous Activities line item in the 28 
State Operations Appropriation of this Act, to the Regular Salaries, Extra 29 
Help, Personal Service Matching, Overtime, and Maintenance and General 30 
Operations line items also in the State Operations Appropriation, to 31 
compensate staff who work during the summer months on summer projects and to 32 
cover other expenses of summer project activities. The Miscellaneous 33 
Activities line item may also be used for the annual cost related to the 34 
payment of contracted interpreter services, compensation of eligible staff 35 
for shift differential pay, and compensation of employees for performance of 36    	SB75

duties assigned as referenced in the Special Allowance Special Language of 1 
this Act.  Such additional compensation shall not be construed as exceeding 2 
the maximum salary authorized for said employees. 3 
   The provisions of this section shall be in effect only from July 1, 	2024 4 
2025 through June 30, 2025 2026. 5 
 6 
 SECTION 16. SPECIAL LANGUAGE.  NOT TO BE INCORPORATED INTO THE ARKANSAS 7 
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW.   8 
CARRY FORWARD OF FUNDS - ASD. 9 
 (a)  The Chief Fiscal Officer of the State shall cause to be 10 
transferred on his or her books and those of the State Treasurer and Auditor 11 
of State the balance of General Revenue funds remaining in the School for the 12 
Deaf Fund Account on June 30, 2024 2025 into a sub-fund created within the 13 
School for the Deaf Fund Account to be used for special maintenance, 14 
renovations, or future construction projects of the Department of Education 	- 15 
Arkansas School for the Deaf.  16 
 (b)  Any carry forward of the unexpended balance of funding as 17 
authorized herein, may be carried forward under the following conditions: 18 
 (1)  The Office of Budget of the Department of Finance and 19 
Administration shall report to the Legislative Council all amounts carried 20 
forward by the September meeting of the Legislative Council or the Joint 21 
Budget Committee meeting which report shall include the name of the agency, 22 
board, commission, or institution and the amount of funding carried forward, 23 
the program name or line item and the funding source; and 24 
 (2) The Department of Education - Arkansas School for the Deaf 25 
shall provide a written report to the Legislative Council or Joint Budget 26 
Committee containing all information set forth in subdivision (b)(1) of this 27 
section no later than thirty (30) days prior to the time the Department 28 
presents its budget request to the Legislative Council or Joint Budget 29 
Committee, or both; and 30 
 (3) Thereupon, the Department of Finance and Administration shall 31 
include all information obtained in subdivision (b)(2) of this section in the 32 
budget manuals. 33 
 The provisions of this section shall be in effect only from July 1, 34 
2024 2025 through June 30, 2025 2026. 35

 SECTION 17. COMPLIANCE WITH OTHER LAWS.  Disbursement of funds 1 
authorized by this act shall be limited to the appropriation for such agency 2 
and funds made available by law for the support of such appropriations; and 3 
the restrictions of the State Procurement Law, the General Accounting and 4 
Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary 5 
Procedures and Restrictions Act, or their successors, and other fiscal 6 
control laws of this State, where applicable, and regulations promulgated by 7 
the Department of Finance and Administration, as authorized by law, shall be 8 
strictly complied with in disbursement of said funds. 9 
 10 
 SECTION 18. LEGISLATIVE INTENT.  It is the intent of the General 11 
Assembly that any funds disbursed under the authority of the appropriations 12 
contained in this act shall be in compliance with the stated reasons for 13 
which this act was adopted, as evidenced by the Agency Requests, Executive 14 
Recommendations and Legislative Recommendations contained in the budget 15 
manuals prepared by the Department of Finance and Administration, letters, or 16 
summarized oral testimony in the official minutes of the Arkansas Legislative 17 
Council or Joint Budget Committee which relate to its passage and adoption. 18

 SECTION 19. EMERGENCY CLAUSE.  It is found and determined by the 20 
General Assembly, that the Constitution of the State of Arkansas prohibits 21 
the appropriation of funds for more than a one (1) year period; that the 22 
effectiveness of this Act on July 1, 2025 is essential to the operation of 23 
the agency for which the appropriations in this Act are provided, and that in 24 
the event of an extension of the legislative session, the delay in the 25 
effective date of this Act beyond July 1, 2025 could work irreparable harm 26 
upon the proper administration and provision of essential governmental 27 
programs. Therefore, an emergency is hereby declared to exist and this Act 28 
being necessary for the immediate preservation of the public peace, health 29 
and safety shall be in full force and effect from and after July 1, 2025. 30
