2525 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 23

2727 SECTION 1. APPROPRIATION - USED TIRE RECYCLING AND ACCOUNTABILITY 25
2828 PROGRAM. There is hereby appropriated, to the Department of Energy and 26
2929 Environment, to be payable from the Used Tire Recycling Fund , for expenses of 27
3030 the Department of Energy and Environment - Division of Environmental Quality 28
3131 - Used Tire Recycling and Accountability Program for the fiscal year ending 29
3232 June 30, 2025, the following: 30

4141 SECTION 2. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 1
4242 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. FUNDING 2
4343 TRANSFER - USED TIRE RECYCLING AND ACCOUNTABILITY PROGRAM. Immediately upon 3
4444 the effective date of this act, the C hief Fiscal Officer of the State shall 4
4545 transfer on his or her books and those of the State Treasure r and the Auditor 5
4646 of the State the sum of five million dollars ($5,000 ,000) from the General 6
4747 Revenue Allotment Reserve Fund to the Used Tire Recycling Fund to provide 7
4848 funds for the appropriation provided herein. 8
4949 The provisions of this section shall be in effect only from July 1, 9
5050 2024 through June 30, 2025. 10

5252 SECTION 3. COMPLIANCE WITH OTHER LAWS. Disbursement of funds 12
5353 authorized by this act shall be limited to the appropriation for such agency 13
5454 and funds made available by law for the support of such appropriations; and 14
5555 the restrictions of the State Procurement Law, the General Accounting and 15
5656 Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary 16
5757 Procedures and Restrictions Act, or their successors, and other fiscal 17
5858 control laws of this State, where applicable, and regulations promulgated by 18
5959 the Department of Finance and Administration, as authorized by law, shall be 19
6060 strictly complied with in disbursement of said funds. 20

6262 SECTION 4. LEGISLATIVE INTENT. It is the intent of the General 22
6363 Assembly that any funds disbursed under the authority of the appropriations 23
6464 contained in this act shall be in compliance with the stated reasons for 24
6565 which this act was adopted, as evidenced by the Agency Requests, Executive 25
6666 Recommendations and Legislative Recommendations contained in the budget 26
6767 manuals prepared by the Department of Finance and Administration, letters, or 27
6868 summarized oral testimony in the official minutes of the Arkansas Legislative 28
6969 Council or Joint Budget Committee which relate to its passage and adoption. 29

7171 SECTION 5. EMERGENCY CLAUSE. It is found and determined by the General 31
7272 Assembly, that funds provided by the General Assembly for the operations of 32
7373 the Department of Energy And Environment - Division of Environmental Quality 33
7474 are, due to unforeseen circumstances, insufficient for the Department of 34
7575 Energy And Environment - Division of Environmental Quality to continue to 35
7676 provide essential governmental services; that the provisions of this act will 36 SB8

7979 provide the necessary monies for the Department of Energy And Environment - 1
8080 Division of Environmental Quality to continue such services; and that a delay 2
8181 in the effective date of this Act could work irreparable harm upon the proper 3
8282 administration and provision of essential governmental programs. Therefore, 4
8383 an emergency is hereby declared to exist and this Act being necessary for the 5
8484 immediate preservation of the public peace, health and safety shall be in 6
8585 full force and effect from and after the date of its passage and approval. 7
8686 If the bill is neither approved nor vetoed by the Governor, it shall 8
8787 become effective on the expiration of the period of time during which the 9
8888 Governor may veto the bill. If the bill is vetoed by the Governor and the 10
8989 veto is overridden, it shall become effective on the date the last house 11
9090 overrides the veto. 12
