Act 62 of the Regular Session *JAR041* 01/21/2025 10:22:02 AM JAR041 State of Arkansas 1 95th General Assembly A Bill 2 Regular Session, 2025 SENATE BILL 80 3 4 By: Joint Budget Committee 5 6 7 For An Act To Be Entitled 8 AN ACT TO MAKE AN APPROPRIATION FOR EXPENSES OF THE 9 GOVERNOR'S LEGISLATIVE LIAISONS DURING THE NINETY -10 FIFTH SESSION OF THE ARKANSAS GENERAL ASSEMBLY FOR 11 THE OFFICE OF THE GOVERNOR FOR THE FISCAL YEAR ENDING 12 JUNE 30, 2025; AND FOR OTHER PURPOSES. 13 14 15 Subtitle 16 AN ACT FOR THE OFFICE OF THE GOVERNOR - 17 LEGISLATIVE LIAISONS APPROPRIATION FOR 18 THE 2024-2025 FISCAL YEAR. 19 20 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 21 22 SECTION 1. APPROPRIATION - LEGISLATIVE ASSISTANCE . There is hereby 23 appropriated, to the Office of the Governor , to be payable from the 24 Constitutional Officers Fund , for operating expenses of the Office of the 25 Governor for the fiscal year ending June 30, 2025, the following: 26 27 ITEM FISCAL YEAR 28 NO. 2024-2025 29 (01) MAINTENANCE, OPERATION AND EXPENSES $226,250 30 31 SECTION 2. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 32 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. LIAISONS 33 AUTHORIZED. The Governor is hereby authorized to employ one (1) Lead 34 Legislative Liaison who shall serve withou t pay but shall be ent itled to per 35 diem of up to two hundred and fifty dollars ($250) for each day the General 36 SB80 2 01/21/2025 10:22:02 AM JAR041 Assembly is in Regular Session and nine (9) Legislative Liaisons who shall 1 serve without pay but shall each b e entitled to per diem of up to two hundred 2 dollars ($200) for each day the General Assembly is in Regular Session. 3 After receiving approval of the Governor, the Department of Transformation 4 and Shared Services is here by authorized to process payments to said Liaisons 5 from funds authorized by this Act. 6 7 SECTION 3. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 8 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. PAYMENT OF 9 PER DIEM. Per Diem as authorized in Section 2 - Liaisons Authorized of this 10 Act shall be in effect from and after January 13, 2025. 11 12 SECTION 4. COMPLIANCE WITH OTHER LAWS. Disbursement of funds 13 authorized by this act shall be limited to the appropriation for such agency 14 and funds made available by law for the support of such appropriations; and 15 the restrictions of the State Procurement Law, the General Accounting and 16 Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary 17 Procedures and Restrictions Act, or their successors, and other fiscal 18 control laws of this State, where applicable, and regulations promulgated by 19 the Department of Finance and Administration, as authorized by law, shall be 20 strictly complied with in disbursement of said funds. 21 22 SECTION 5. LEGISLATIVE INTENT. It is the intent of the General 23 Assembly that any funds disbursed under the authority of the appropriations 24 contained in this act shall be in compliance with the stated reasons for 25 which this act was adopted, as evidenced by the Agency Requests, Executive 26 Recommendations and Legislative Recommendations contained in the budget 27 manuals prepared by the Department of Finance and Administration, letters, or 28 summarized oral testimony in the official minutes of the Arkansas Legislative 29 Council or Joint Budget Committee which relate to its passage and adoption. 30 31 SECTION 6. EMERGENCY CLAUSE. It is found and determined by the General 32 Assembly, that the Constitution of the State of Arkansas prohibits the 33 appropriation of funds for more than a one (1) year period; that the 34 effectiveness of this Act on the date of its passage and approval is 35 essential to the operation of the agency for which the appropriations in this 36 SB80 3 01/21/2025 10:22:02 AM JAR041 Act are provided, and that in the event of an extension of the Regular 1 Session, the delay in the effective date of this Act beyond the date of its 2 passage and approval could work irreparable harm upon the proper 3 administration and provision of essential governmental programs. Therefore, 4 an emergency is hereby declared to exist and this Act being necessary for the 5 immediate preservation of the public peace, health and safety shall be in 6 full force and effect from and after the date of its passage and approval. If 7 the bill is neither approved nor vetoed by the Governor, it shall become 8 effective on the expiration of the period of time during which the Governor 9 may veto the bill.
