651+Fiscal Officer of the State, institutions of higher education may transfer 3
652+appropriation from the cash contingency appropriation to any other 4
653+appropriation made to the institution from cash funds including the 5
654+establishment of commitment items, and may transfer appropriation from the 6
655+contingency appropriation made payable from each institution’s State Treasury 7
656+Fund to the state operations appropriation made payable from each 8
657+institution’s State Treasury Fund including the establishment of commitment 9
658+items, and may transfer appropriation from the contingency appropriation made 10
659+payable from the Tobacco Settlement Program Fund Accounts to any other 11
660+appropriation made to the institution from Tobacco Settlement Program Fund 12
661+Accounts including the establishment of commitment items. 13
662+ (b) Contingency appropriation transfers shall only establish and 14
663+supplement commitment items that were recommended by the Higher Education 15
664+Coordinating Board in the budget manuals presented to the Legislative Council 16
665+and Joint Budget Committee. 17
666+ (c) The Department of Education - Division of Higher Education shall 18
667+report contingency appropriation transfers and the establishment of any 19
668+commitment items authorized by this Section to the Legislative Council or 20
669+Joint Budget Committee for review during its July meeting. The report shall 21
670+include, by institution, the establishment of, and the amounts transferred 22
671+to, each commitment item, the reasons therefor and the source of funds. 23
672+Institutions shall submit contingency appropriation transfer and commitment 24
673+item establishment requests authorized by this Section to the D ivision of 25
674+Higher Education no later than July 1. Upon the failure of an institution to 26
675+submit the required information by the July 1 deadline, the Department of 27
