25	23		BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 21

27	25		SECTION 1. Arkansas Code § 23 -112-302(e), concerning the requirements 23
28	26		for licensing of a new motor vehicle dealer, is amended to read as follows: 24
29	27		(e)(1) The Except as provided by subdivision (e)(2) of this section, 25
30	28		the applicant for a license as a new motor vehicle dealer shall furnish 26
31	29		satisfactory evidence that the applicant: 27
32	30		(1)(A) Maintains adequate space in the building or 28
33	31		structure wherein the applicant's established business is conducted for the 29
34	32		display of new motor vehicles or will have the facilities within a reasonable 30
35	33		time after receiving a license; 31
36	34		(2)(B) Has or will have adequate facilities in the 32
37	35		building or structure to perform repair and service work on motor vehicles 33
38	36		and adequate space for storage of new parts and accessories for the motor 34
39	37		vehicles; and 35

46	42		(2) A new all-terrain vehicle dealer or new low speed vehicle 2
47		-	dealer is not required to: 3
48		-	(A) Have a dedicated service and parts area inside of the 4
49		-	building or structure wherein the dealer's established business is conducted; 5
50		-	or 6
51		-	(B) Perform repair and warranty services on a motor 7
52		-	vehicle at the licensed location. 8
53		-	(3) A new all-terrain vehicle dealer or new low speed vehicle 9
54		-	dealer shall: 10
55		-	(A) Provide: 11
56		-	(i) Service of an all -terrain vehicle or low speed 12
57		-	vehicle sold by the new all -terrain vehicle dealer or new low speed vehicle 13
58		-	dealer; or 14
59		-	(ii) To the purchaser of the all -terrain vehicle or 15
60		-	low speed vehicle the name of a service provider within forty (40) miles of 16
61		-	the new all-terrain vehicle dealer or new low speed vehicle dealer that will 17
62		-	service the all-terrain vehicle or low speed vehicle sold by the new all -18
63		-	terrain vehicle dealer or new low speed vehicle dealer to the purchaser; 19
64		-	(B) Provide a warranty or a manufacturer's warranty on an 20
65		-	all-terrain vehicle or low speed vehicle sold by the new all -terrain vehicle 21
66		-	dealer or new low speed vehicle dealer; 22
67		-	(C) Coordinate with a warranty service provider within 23
68		-	forty (40) miles of the new all -terrain vehicle dealer or new low speed 24
69		-	vehicle dealer to service the warranty or manufacturer's warranty provided 25
70		-	under subdivision (e)(3)(B) of this section; 26
71		-	(D) Submit the information concerning a service provider 27
72		-	or warranty service provider identified under subdivision (e)(3)(A)(ii) or 28
73		-	subdivision (e)(3)(C) of this section to the Arkansas Motor Vehicle 29
74		-	commission annually during the renewal of the license for the new all -terrain 30
75		-	vehicle dealer or new low speed vehicle dealer; and 31
76		-	(E) Provide information concerning a service provider or 32
77		-	warranty service provider identified under subdivision (e)(3)(A)(ii) or 33
78		-	subdivision (e)(3)(C) of this section to the purchaser of an all -terrain 34
79		-	vehicle or low speed vehicle sold by the new all -terrain vehicle dealer or 35

85		-	(4) The Arkansas Motor Vehicle commission shall promulgate rules 1
