AN ACT

 

amending title 9, chapter 4, article 6, arizona revised statutes, by adding section 9-461.18; amending title 11, chapter 6, article 2, arizona revised statutes, by adding section 11-820.02; relating to planning and zoning.

 Be it enacted by the Legislature of the State of Arizona: Section 1. Title 9, chapter 4, article 6, Arizona Revised Statutes, is amended by adding section 9-461.18, to read: START_STATUTE9-461.18. Minimum parking requirement; prohibition; definitions A. Notwithstanding any other law, a city or town may not adopt a land use regulation or general or specific plan PROVISION OR impose as a condition for approving a building or use permit any regulation that requires more than one motor vehicle parking space per residential dwelling unit if the residential dwelling unit is located within an urbanized area. b. for the purposes of this SECTION: 1. "Residential dwelling unit" means: (a) a building or structure or part of a building or structure that is used for a home or residence by one or more persons who maintain a household. (b) a mobile home, regardless of ownership of the land. 2. "urbanized area" means an urbanized area as defined in the decennial census by the United States census bureau. END_STATUTE Sec. 2. Title 11, chapter 6, article 2, Arizona Revised Statutes, is amended by adding section 11-820.02, to read: START_STATUTE11-820.02. Minimum parking requirement; prohibition; definitions A.
