(TEXT OF BILL BEGINS ON NEXT PAGE) Be it enacted by the Legislature of the State of Arizona: Section 1. Title 41, chapter 21, article 1, Arizona Revised Statutes, is amended by adding section 41-2410, to read: START_STATUTE41-2410. Public safety funding committee; establishment; members; annual report; public hearings A. The public safety funding committee is established and consists of the following members: 1. The chief justice of the supreme court who shall serve as chairperson of the committee and who is a nonvoting member. 2. Two members of the senate. the president of the senate shall appoint one member and the minority leader shall appoint the other member. 3. Two members of the House of representatives. The speaker of the house of representatives shall appoint one member and the minority leader shall appoint the other member. 4. the attorney general or the attorney general's designee. 5. The director of the department of public safety or the director's designee. 6. One criminal defense attorney who is appointed by the governor. 7. ONe prosecutor who is appointed by the governor. 8. One representative of a tribal government who is appointed by the governor. 9. One member who is employed by a nonprofit organization that primarily addresses police violence and excessive use of force and who is appointed by the governor from a list of candidates provided by the legislature. 10. One member who is employed by a social services state agency who is appointed by the governor. 11. Two members who are employed by a county or local law enforcement agency and who are appointed by the governor. 12. One representative of a university who instructs on the criminal justice system and who is appointed by the governor from a list of candidates that is provided by the legislature. 13. One member who is a mental health expert and who is appointed by the governor from a list of candidates that is provided by the legislature. 14. One member who has experience working and advocating on behalf of communities of color and who is appointed by the governor from a list of candidates that is provided by the legislature. 15. One member who has experience working with youth programs and who is appointed by _______. B. The committee shall: 1. Conduct a comprehensive review of state and local public safety agency budgets and assess the budgets in light of all of the following: (a) Peer-reviewed research on effective policing practices. (b) Peer-reviewed research on crime prevention. (c) Peer-reviewed research on policing alternatives and community investment as a tool to support public safety. (d) The budgets of public safety agencies in other states. 2. Solicit public input on this states public safety systems and policy options to generate savings, increase public safety and reinvest in communities through evidence-based practices. The subjects of public input shall include, at a minimum, community needs and research highlighting best practices for all of the following: (a) Youth programs. (b) Mental health services. (c) Housing and homelessness prevention services. (d) Job training. (e) Job creation. (f) Small business support. 3. solicit public input through, at a minimum, an online form and hold five public hearings: (a) Before the drafting of the first Committee report required by subsection C of this section. (b) at venues in communities that are significantly affected by policing practices. For the purposes of this subdivision: (i) The hearings shall be held at locations that are geographically dispersed throughout this STATE and at times that are intended to maximize attendance. (ii) The Committee shall arrange for testimony to be submitted orally or in writing. 4. Develop and make recommendations regarding policy options to generate savings, increase public safety and reinvest in communities through evidence-based practices, considering, at a minimum, community needs for all of the following: (a) Youth programs. (b) Mental health services. (c) Housing and homelessness prevention services. (d) Job training. (e) Job creation. (f) Small business support. 5. Engage in strategic planning for implementing policy recommendations. 6. Develop a plan for measuring the impact of policy changes and reallocating resources recommended by the Committee. 7. Make recommendations on an affirmative vote of a majority of the members. C. Within six months after the effective date of this section and annually thereafter the Committee shall prepare a report of the committee's findings and recommendations for legislative and executive action, make the report available to the public online and submit the report to the Governor, the Legislature and the Chief Justice of the Supreme Court and provide a copy of this report to the Secretary of State. D. Within two months after issuing each annual report, the Committee shall hold at least two public hearings soliciting public comment on the report. E. Beginning with the second annual report and each subsequent report thereafter, the Committee shall include a summary of the comments that are received at the public hearings and each department's response to the comments. F. Each report shall indicate which recommendations a state department or others can pursue without additional legislative action. Unless precluded by state or federal law, a DEPARTMENT may enact recommendations immediately and shall issue public replies to Committee reports indicating whether a recommendation can or will be acted on or any obstacles faced by the DEPARTMENT in acting on the recommendation. G. For recommendations that require additional action by the legislature, the report shall include specific requests and outlines of legislative action needed, including budget requests. END_STATUTE Sec. 2. Delayed repeal Section 41-2410, Arizona Revised Statutes, as added by this act, is repealed from and after June 30, 2028.
