7878 Be it enacted by the Legislature of the State of Arizona: Section 1. Title 11, chapter 2, article 4, Arizona Revised Statutes, is amended by adding section 11-269.29, to read: START_STATUTE11-269.29. Board of supervisors; ordinances; maximum acreage; energy production; definition A. The board of supervisors in each county may adopt ordinances or include in the county comprehensive plan a maximum acreage allowed in the county that may be dedicated to or developed for electric energy production. The maximum acreage allowance may include any of the following: 1. A set number of acres. 2. A percentage of the total land surface area of the county. 3. A percentage of state-owned land within the county. 4. A percentage of federally owned land within the county. 5. A percentage of privately owned land within the county. B. If the county adopts a maximum acreage allowance pursuant to subsection A of this section, the county shall include enough acreage to encompass the existing electric energy production facilities in the county at the time the board of supervisors adopts the maximum acreage. C. When calculating the maximum acreage allowance, both of the following apply: 1. The acreage attributed to wind farms or wind turbines is the total acreage of the boundary of the wind farm or site. 2. The maximum acreage does not include above-ground transmission infrastructure, including pipelines and transmission lines. D. The board of supervisors in each county shall convene within ninety days after the effective date of this section to determine whether the board will establish a maximum acreage allowance pursuant to subsection A of this section and the amount of the maximum acreage allowance. E. The board of supervisors may amend or repeal ordinances adopted pursuant to this section as prescribed by section 11-251.05. F. For the purposes of this section, "electric energy production" includes energy produced from any electric generating resource, including conventional energy resources and renewable energy resources.
