An Act

 

amending section 13-3884, Arizona Revised Statutes; relating to theft.

 Be it enacted by the Legislature of the State of Arizona: Section 1. Section 13-3884, Arizona Revised Statutes, is amended to read: START_STATUTE13-3884. Arrest by private person A private person may make an arrest: 1. When the person to be arrested has in his the private person's presence committed a misdemeanor amounting to a breach of the peace, a theft of property from a retail store or a felony. 2. When a felony has been in fact committed and he the private person has reasonable ground to believe that the person to be arrested has committed it. END_STATUTE 

Be it enacted by the Legislature of the State of Arizona:

Section 1. Section 13-3884, Arizona Revised Statutes, is amended to read:

START_STATUTE13-3884. Arrest by private person

A private person may make an arrest:

1. When the person to be arrested has in his the private person's presence committed a misdemeanor amounting to a breach of the peace, a theft of property from a retail store or a felony.

2. When a felony has been in fact committed and he the private person has reasonable ground to believe that the person to be arrested has committed it. END_STATUTE
