| 66 | 67 | | Be it enacted by the Legislature of the State of Arizona: Section 1. Title 13, chapter 38, article 6, Arizona Revised Statutes, is amended by adding section 13-3875.01, to read: START_STATUTE13-3875.01. Cross-certification of peace officers from adjoining states; policy; powers; qualifications; liability; records; definition A. The sheriff of each county shall develop and adopt a policy on cross-certification of peace officers from adjoining states, including whether to allow cross-certification in that county. B. A peace officer who is employed by a county of an adjoining state and who has completed the basic training curriculum for the peace officer's agency shall possess and exercise all law enforcement powers of peace officers in this state pursuant to subsection f of this section for one year, including, if directed by the peace officer's employer, the capability to enforce the criminal laws of this state if the peace officer does both of the following: 1. Submits to the sheriff a written request for certification as a peace officer in this state. 2. Submits evidence that the peace officer has been certified as a peace officer, is authorized by state law to engage in or supervise the prevention, detection, investigation or prosecution of a violation of law and is authorized by state law to make arrests, serve warrants and carry firearms. C. Each peace officer from an adjoining state who requests cross-certification may submit to the sheriff a written request for certification as a peace officer in this state pursuant to subsection B of this section. The cross-certification remains in effect for one year from the date on which the certification was authorized by the sheriff. D. this state or any political subdivision of this state is not liable for any act or failure to act by a peace officer from an adjoining state. the peace officer's home state is liable for damages arising from an act or failure to act by the peace officer. E. The Arizona peace officer standards and training board shall maintain records of all peace officers from adjoining states who are certified as peace officers in this state. F. A peace officer from an adjoining state is not subject to the requirements prescribed in Section 41-1823, subsection B if an emergency in a county in this state necessitates the aid of or assistance from the peace officer from an adjoining state. G. For the purposes of this section, "emergency" means a situation in which a person is or is reasonably believed to be in imminent danger of serious physical injury or in which property is or is reasonably believed to be in imminent danger of damage or destruction.END_STATUTE |
