69- Be it enacted by the Legislature of the State of Arizona: Section 1. Voter registrants; satisfactory proof of citizenship; delayed repeal A. If a county recorder receives or has received information from the motor vehicle division of the department of transportation that a registered voter used the state voter registration form and has not provided satisfactory evidence of United States citizenship to the motor vehicle division and the voter has not provided satisfactory evidence of United States citizenship to the county recorder by some other means, the county recorder shall: 1. Within sixty days give notice to the voter that: (a) Unless the voter provides satisfactory proof of United States citizenship as otherwise provided by law to the county recorder within thirty-five days after notice is sent, the voter will be moved to not registered status and will not be eligible to vote until valid proof of United States citizenship is provided to the county recorder. (b) If the voter provides satisfactory proof of United States citizenship as otherwise provided by law before 7:00 P.M. on election day, the voter is eligible to vote a full ballot at that election. (c) Voters that were registered on or before January 24, 2005, are considered grandfathered and evidence of citizenship may not be required unless they register in a different Arizona county. (d) Voters that use an application for registration on a form produced by the United States election assistance commission may be made federal only voters if satisfactory evidence of United States citizenship is not provided to the county recorder. 2. If the voter does not provide documentary proof of United States citizenship within the time prescribed, the voters registration status will remain not registered and the voter will not be eligible to vote until valid proof of United States citizenship is provided. If after the next general election, the voter has not provided satisfactory proof of United States citizenship, the county recorder shall cancel the voters record. B. This section is repealed from and after December 31, 2026. Sec. 2. Emergency This act is an emergency measure that is necessary to preserve the public peace, health or safety and is operative immediately as provided by law.
78+ Be it enacted by the Legislature of the State of Arizona: Section 1. Section 32-742.01, Arizona Revised Statutes, is amended to read: START_STATUTE32-742.01. Investigations A. The board on its own motion, or on receiving a complaint or other information suggesting violations of this chapter or board rules, may conduct or direct an authorized committee to conduct an initial analysis, which shall be completed before the board may open an investigation file pursuant to subsection B to determine whether reasonable cause exists to believe that there is a violation of this chapter or board rules. The board or its authorized committee may designate one or more persons of appropriate competence to assist the board in its initial analysis. B. After an initial analysis if the board finds reasonable cause to believe there is a violation of this chapter or board rules, the board may direct that an investigation file be opened to determine if there is reasonable cause to institute disciplinary proceedings under this chapter. An investigation is not a prerequisite to disciplinary proceedings under this chapter if reasonable cause can be determined without an investigation. C. To assist in the investigation, the board or an authorized committee may designate one or more persons of appropriate competence to be investigators. When completing an investigation, the investigator shall file a report with the board or an authorized committee. Based on the investigator's report, the board or authorized committee may request further investigation, hold voluntary investigative interviews, or make appropriate recommendations for dismissal, letters of concern, consent orders or other disciplinary actions. D. If the board does not find reasonable cause to believe that there is a violation of this chapter or board rules, the board shall close the investigation file. END_STATUTE
