71- Be it enacted by the Legislature of the State of Arizona: Section 1. Title 15, chapter 14, article 2, Arizona Revised Statutes, is amended by adding section 15-1825, to read: START_STATUTE15-1825. Proof of immunizations; exemptions; definitions A. If a higher education institution requires students to submit documentary proof to enroll in or attend the higher education institution, the higher education institution shall do both of the following: 1. Fully disclose to prospective students the requirements and exemptions prescribed in this section. 2. Exempt any student who is at least eighteen years of age from the requirement if the student submits either of the following: (a) A signed statement that the student both: (i) Has received information about immunizations provided by the department of health services and understands the risks and benefits of immunizations and the potential risks of nonimmunization. (ii) Does not consent to the immunizations due to personal beliefs, including religious beliefs. (b) A written certification that is signed by the student and by a physician or a registered nurse practitioner, that states that one or more of the required immunizations may be detrimental to the student's health and that indicates the specific nature and probable duration of the medical condition or circumstance that precludes immunization. An exemption under this subdivision is valid only during the duration of the circumstance or condition that precludes immunization. B. For the purposes of this section: 1. "documentary proof" has the same meaning prescribed in section 15-871. 2. "higher education institution" includes any of the following: (a) A university under the jurisdiction of the Arizona board of regents. (b) A community college as defined in section 15-1401. (c) A career technical education district that provides instruction to adult students. END_STATUTE
78+ Be it enacted by the Legislature of the State of Arizona: Section 1. Section 15-873, Arizona Revised Statutes, is amended to read: START_STATUTE15-873. Exemptions; nonattendance during outbreak A. Documentary proof is not required for a pupil student to be admitted to school if one of the following occurs: 1. The parent or guardian of the pupil student submits a signed statement to the school administrator stating that the parent or guardian has received information about immunizations provided by the department of health services and understands the risks and benefits of immunizations and the potential risks of nonimmunization and that, due to personal beliefs, the parent or guardian does not consent to the immunization of the pupil student. 2. The student is at least eighteen years of age and submits a signed statement to the school administrator stating that the student has received information about immunizations provided by the department of health services and understands the risks and benefits of immunizations and the potential risks of nonimmunization and that, due to personal beliefs, the student does not consent to the immunization. 2. 3. The school administrator receives written certification that is signed by the parent or guardian and by a physician or a registered nurse practitioner, that states that one or more of the required immunizations may be detrimental to the pupil's student's health and that indicates the specific nature and probable duration of the medical condition or circumstance that precludes immunization. B. An exemption pursuant to subsection A, paragraph 2 3 of this section is only valid only during the duration of the circumstance or condition that precludes immunization. C. Pupils Students who lack documentary proof of immunization shall not attend school during outbreak periods of communicable immunization-preventable diseases as determined by the department of health services or local health department. The department of health services or local health department shall transmit notice of this determination to the school administrator responsible for the exclusion of the pupils students. END_STATUTE
