Title 36, chapter 5, article 1, Arizona Revised Statutes, is amended by adding section 36-503.04, to read: START_STATUTE36-503.04. Maternal mental health conditions; educational materials and information; distribution; definitions A. The department shall identify and compile relevant educational materials and information for health care professionals and patients regarding maternal mental health conditions, including postpartum depression, that HAVE been developed by organizations with expertise in maternal mental health conditions. The materials shall include information on the symptoms and methods of coping with postpartum depression, as well as treatment options and resources. If the DEPARTMENT is unable to identify existing materials that comply with the requirements of this subsection, the department shall develop written educational materials and information, taking into consideration relevant clinical practice guidelines, peer-reviewed studies and recommendations from experts in maternal mental health care, including the centers for disease control and prevention, professional associations and patient advocacy groups. B. The department shall post the materials and information required by subsection A of this section on its public website. The department shall make available or distribute the materials and information in physical form on request. C. The department shall periodically review the materials and information to determine their accuracy and ensure that they reflect the most up-to-date and accurate information. D. A health care institution shall provide each departing new parent and other family members, as appropriate, with written materials and information compiled or developed pursuant to subsection A of this section on the new parent's discharge from the health care institution. E. Each health care institution, primary care physician and primary care practitioner, or any other health professional who renders prenatal or postnatal care or who provides pediatric infant care, shall provide the materials and information compiled or developed pursuant to subsection A of this section to any woman On learning of a pregnancy or who presents with signs of a maternal mental health disorder at any time during a pregnancy or postpartum period. f. For the purposes of this section: 1. "Health care institution" has the same meaning prescribed in section 36-401. 2. "Primary care physician" and "primary care practitioner" have the same meanings prescribed in section 36-2901. END_STATUTE Sec. 2. Department of health services; advisory committee on obstetrics, gynecology and maternal mental health in rural communities; membership; report; delayed repeal A. The department of health services shall establish an advisory committee on obstetrics, gynecology and maternal mental health in rural communities to develop recommendations to ensure the availability of obstetrics, gynecology and maternal mental health services in low-volume, high-risk rural communities. B. The director of the department of health services shall appoint the following members to the advisory committee: 1. One member who is a representative of a statewide association of hospitals that convenes an alliance for innovation on maternal health. 2. One member who is a representative from a critical access hospital that offers maternity care services, including labor and delivery. 3. One member who is a representative from a critical access hospital that does not offer maternity care services. 4. One member who is a representative from a hospital system in a county with a population of less than one million five hundred thousand persons that delivered more than ten percent of the infants born in this state in 2024. 5. Six health professionals whose current health care practice includes maternity care services in rural communities as follows: (a) A physician who is licensed pursuant to title 32, chapter 13 or 17, Arizona Revised Statutes, and who specializes in obstetrics and gynecology. (b) A physician who is licensed pursuant to title 32, chapter 13 or 17, Arizona Revised Statutes, who specializes in obstetrics and gynecology and whose practice includes maternity care for patients who are transported from one or more rural communities. (c) A physician who is licensed pursuant to title 32, chapter 13 or 17, Arizona Revised Statutes, and who specializes in family medicine. (d) A physician who is licensed pursuant to title 32, chapter 13 or 17, Arizona Revised Statutes, and who specializes in emergency medicine. (e) A certified nurse midwife who is licensed pursuant to title 32, chapter 15, Arizona Revised Statutes. (f) A doula who is certified pursuant to title 36, chapter 6, article 7.2, Arizona Revised Statutes. 6. One member who is a representative from a federally qualified community health center that administers a rural maternity and obstetrics management strategies program. 7. One member who is a representative from an Indian health service facility or a tribal 638 facility that offers maternity care services, including labor and delivery. 8. One member who is a representative from an Indian health service facility or a tribal 638 facility that does not offer maternity care services. 9. Two members who are representatives of different health care insurers that are licensed pursuant to title 20, Arizona Revised Statutes, and that offer insurance products that include coverage for obstetrics, gynecology and maternal mental health services. 10. One member who is a representative from an emergency air ambulance provider that serves a rural community. 11. One member who is a representative of the statewide perinatal psychiatry access line. C. The directors of the Arizona health care cost containment system, the department of health services and the department of insurance and financial institutions, or the directors' designees, shall serve as nonvoting members of the advisory committee. D. Advisory committee members are not eligible to receive compensation or the reimbursement of expenses. E. The advisory committee shall: 1. Develop recommendations to enhance and preserve the delivery and access of preconception, prenatal, pregnancy, labor and delivery, maternal mental health and postpartum care services in rural hospitals and rural communities. 2. Develop recommendations to enhance the delivery of and access to evidenced-based postpartum depression screening and referrals for treatments, including recommendations that consider public and private insurance coverage, provider reimbursement incentives and pharmacological treatment options. 3. Submit a written report of its findings on or before December 31, 2026, to the governor, the president of the senate and the speaker of the house of representatives and shall provide a copy of this report to the secretary of state. F. The committee may hold hearings and take testimony from stakeholders and affected persons, including members of the public. G. This section is repealed from and after June 30, 2027. |
