69- Be it enacted by the Legislature of the State of Arizona: Section 1. Section 15-708, Arizona Revised Statutes, is amended to read: START_STATUTE15-708. Mathematics proficiency; parental notification; advanced placement; reporting requirements; posting; policies and guidelines A. If the statewide assessment results are available before the start of each school year, each school district and charter school shall provide notification no not later than the first half of the second quarter of the school year to parents of pupils in grades six through eight who have not demonstrated proficiency in grade-level mathematics based on available local or statewide assessments. The notification shall include the following information: 1. A description of the pupil's mathematics deficiencies as demonstrated by the statewide assessment. 2. A description of the current mathematics services provided by the school district or charter school, including supplemental instructional services and supporting programs that are designed to remediate mathematics deficiencies. B. Each school district and charter school shall enroll a student who is in sixth, seventh or eighth grade in an advanced mathematics course, IF AVAILABLE, for the next mathematics course in which the student enrolls if the student's parent does not object and the student meets at least one of the following: 1. Demonstrates the highest proficiency in grade-level mathematics on the statewide assessment. 2. Demonstrates the highest proficiency in grade-level mathematics on an end-of-course exam or a benchmark assessment that is administered by the school district or charter school or by the school in which the student was enrolled in the immediately preceding school year. 3. Earns a letter grade of at least A, or the equivalent, in the mathematics course in which the student was most recently enrolled. 4. Requests, or the student's parent requests, that the student be enrolled in an advanced mathematics course. C. Each school district and charter school that provides instruction to students in any of grades five through eight in this state shall annually report to the department all of the following information: 1. The number of students in each of grades six, seven and eight, disaggregated by race, family income and gender, who: (a) Demonstrated the highest proficiency in grade-level mathematics pursuant to subsection B, paragraph 1, 2 or 3 of this section for the immediately preceding school year. (b) Demonstrated the highest proficiency in grade-level mathematics pursuant to subsection B, paragraph 1, 2 or 3 of this section for the immediately preceding school year and either: (i) Enrolled in an advanced mathematics course in the current school year. (ii) Did not enroll in an advanced mathematics course in the current school year because the student's parent objected to the enrollment. (iii) Did not enroll in an advanced mathematics course in the current school year because an advanced mathematics course was not available. 2. The number of students, disaggregated by grade level, race, family income and gender, who did not demonstrate the highest proficiency in grade-level mathematics pursuant to subsection B, paragraph 1, 2 or 3 of this section for the immediately preceding school year and who enrolled in an advanced mathematics course in the current school year. 3. The average score in grade-level mathematics or an end-of-course exam or a benchmark assessment that is administered by the school district or charter school, disaggregated by grade level, race, family income and gender, for each of the following: (a) Students described in paragraph 1, subdivision (b), item (i) of this subsection. (b) Students described in paragraph 1, subdivision (b), item (ii) of this subsection. (c) Students described in paragraph 2 of this subsection. (d) All other students who are enrolled in the school district or charter school. 4. A list of advanced mathematics courses offered by the school district or charter school to students in grades six, seven or eight. 5. A list of resources that the school district or charter school offers to support students in mathematics courses and the number of students who participated in each resource during the current school year. D. The department shall annually compile reports received pursuant to subsection C of this section and, to the extent allowed by federal law, post the compiled reports on the department's website. The department may not include personally identifiable information in the compiled reports posted pursuant to this subsection. E. The department shall develop policies and guidelines for the implementation of this section, including guidelines regarding how schools may use a benchmark assessment pursuant to subsection B of this section.
