AN ACT

 

Amending title 36, chapter 29, article 1, Arizona Revised Statutes, by adding section 36-2930.07; relating to the ARizona health care cost containment system.

 Be it enacted by the Legislature of the State of Arizona: Section 1. Title 36, chapter 29, article 1, Arizona Revised Statutes, is amended by adding section 36-2930.07, to read: START_STATUTE36-2930.07. AHCCCS; nonopioid drugs; formulary; definition A. The administration shall ensure that a nonopioid drug that is approved by the united States food and drug administration to treat or manage pain is not treated less favorably on the system's drug formulary with respect to coverage relative to any opioid or narcotic drug to treat or manage pain.  B. For the purposes of this section, "treated less favorably" includes: 1. Designating a nonopioid drug as a nonpreferred drug if an opioid or narcotic drug is designated as a preferred drug. 2. Establishing more restrictive or more extensive utilization controls for the use of a nonopioid drug than the utilization controls required for the use of an opioid or narcotic drug, including prior authorization requirements and step therapy. Be it enacted by the Legislature of the State of Arizona:

Section 1. Title 36, chapter 29, article 1, Arizona Revised Statutes, is amended by adding section 36-2930.07, to read:

A. The administration shall ensure that a nonopioid drug that is approved by the united States food and drug administration to treat or manage pain is not treated less favorably on the system's drug formulary with respect to coverage relative to any opioid or narcotic drug to treat or manage pain. 

B. For the purposes of this section, "treated less favorably" includes:

1. Designating a nonopioid drug as a nonpreferred drug if an opioid or narcotic drug is designated as a preferred drug.
