7474 Be it enacted by the Legislature of the State of Arizona: Section 1. Section 8-901, Arizona Revised Statutes, is amended to read: START_STATUTE8-901. Missing, kidnapped or runaway children; mandatory reporting; location information; disclosure; definitions A. A law enforcement agency that receives a report of a missing, kidnapped or runaway child shall do all of the following: 1. Within two hours after receiving the report and all necessary and available information, submit the following information to the Arizona crime information center, the national crime information center computer networks and the national missing and unidentified persons system: (a) The name, date of birth, sex, race, height, weight and eye and hair color of the child. (b) A recent photograph of the child, if available. (c) The date and location of the last known contact with the child. (d) The category under which the child is reported missing. 2. Not later than thirty days after the original entry of the record, verify and update the record with any additional information, including, where available, medical and dental records and a photograph taken during the previous one hundred eighty days. 3. Institute or assist with appropriate search and investigative procedures. 4. Maintain a close liaison with state and local child welfare systems and the national center for missing and exploited children for the exchange of information and technical assistance in the missing child case. 5. Grant permission to the national crime information center terminal contractor for this state to update the missing child record in the national crime information center computer networks with additional information that is learned during the investigation and that relates to the missing child. B. A law enforcement agency that receives a report of a missing, kidnapped or runaway child who is in the foster care system shall notify the national center for missing and exploited children in addition to the entities listed in subsection A of this section. C. An entry may not be removed from any database or system until the child is found or the case is closed. D. A cellular telephone carrier shall disclose location information of a missing, kidnapped or runaway child who is under eighteen years of age to a law enforcement officer or an employee of a law enforcement agency if: 1. There is reasonable suspicion to believe a cellular device is in the possession of the child and the child may be involved in an emergency situation that could result in the risk of death or serious physical injury. 2. within the preceding twenty-four hours, A cELLULAR device was used by a parent or legal guardian to make an emergency 911 call to request emergency assistance. E. If a cellular telephone carrier discloses location information to a law enforcement officer or an employee of a law enforcement agency pursuant to this section, the cellular telephone carrier shall retain: 1. The name of the law enforcement officer or the employee of the law enforcement agency. 2. A description of the location request from a law enforcement officer or the employee of a law enforcement agency. 3. A declaration that the disclosure of the location information is needed based on one of the conditions described in subsection D of this section. F. A cellular telephone carrier that discloses location information under this section is not liable for that disclosure. G. For the purposes of this section: 1. "cellular telephone carrier" means a wireless services provider as defined in section 9-591 or a mobile carrier that provides wireless communication services to customers and that is regulated by the federal communications commission. 2. "Mobile carrier" means a company that provides wireless connectivity to mobile devices. END_STATUTE
