8080 Be it enacted by the Legislature of the State of Arizona: Section 1. Title 40, chapter 2, Arizona Revised Statutes, is amended by adding article 13, to read: ARTICLE 13. RENEWABLE ENERGY START_STATUTE40-501. Renewable energy resources; public service corporation; public power entity; right of first refusal; rules; exemption; definitions A. A public service corporation that is regulated by the commission or a public power entity shall have the right of first refusal to construct, own or maintain any renewable energy resource that is proposed in this state. B. Within ninety days after a county approves a zoning or special land use permit for a RENEWABLE ENERGY resource: 1. A public service corporation that is operating in this state before the effective date of this section shall give written notice to the commission of the public service CORPORATION'S intention to construct, own or maintain the RENEWABLE energy resource in order to exercise the right of first refusal to construct, own or maintain the renewable energy resource. If the public service CORPORATION fails to provide notice, the public service CORPORATION surrenders the right of first refusal to construct, own or maintain the renewable energy resource and any other public service CORPORATION may file an application with the commission on a form prescribed by the commission to construct, own or maintain the renewable energy resource. 2. A public power entity that is operating in this state before the effective date of this section shall give written notice to the county where the renewable energy resource is proposed to be located of the public power entity's intention to construct, own or maintain the renewable energy resource in order to exercise the right of first refusal to construct, own or maintain the renewable energy resource. If the public power entity fails to provide notice, the public power entity surrenders the right of first refusal to construct, own or maintain the renewable energy resource and any other public power entity may file an application with the county where the renewable energy resource is proposed to be located on a form prescribed by the county to construct, own or maintain the renewable energy resource. C. The commission may adopt rules to implement this article. D. This section does not apply to: 1. Residential rooftop solar systems, WHETHER exporting or nonexporting. 2. Nonexporting renewable energy resources that are not interconnected to transmission infrastructure and that generate power for solely on-site use. e. For the purposes of this section: 1. "Public power entity" has the same meaning prescribed in section 30-801. 2. "renewable energy resource" has the same meaning prescribed in section 41-1520.END_STATUTE
