6780 Be it enacted by the Legislature of the State of Arizona: Section 1. Title 15, chapter 1, article 1, Arizona Revised Statutes, is amended by adding section 15-120.05, to read: START_STATUTE15-120.05. Patriotic youth membership organizations; school access; student recruitment; eligibility; parental notification; definitions A. A school district or charter school may not prevent representatives of an eligible patriotic youth membership organization from engaging in student recruitment pursuant to this section and may not impose limits on representatives of the organization relating to the following activities: 1. Speaking with students in a classroom setting during school hours and instructional time. 2. Distributing informational materials to students in a classroom setting during school hours and instructional time. 3. Providing displays at schools operated by the school district or charter school that include informational flyers. 4. Providing information about the organization through the school district's or charter school's existing communication channels. B. A patriotic youth membership organization is eligible to engage in student recruitment pursuant to this section if it meets all of the following: 1. Serves individuals who are under twenty-one years of age. 2. Has an educational purpose that promotes patriotism and civic involvement. 3. Is listed in one of the following chapters of the United States Code in effect on the effective date of this section, or is the state affiliate of one of the listed groups or organizations: (a) 36 United States Code, subtitle II, part B, chapter 301. (b) 36 United States Code, subtitle II, part B, chapter 309. (c) 36 United States Code, subtitle II, part B, chapter 311. (d) 36 United States Code, subtitle II, part B, chapter 403. (e) 36 United States Code, subtitle II, part B, chapter 709. (f) 36 United States Code, subtitle II, part B, chapter 803. (g) 36 United States Code, subtitle II, part B, chapter 1305. (h) 36 United States Code, subtitle II, part B, chapter 1401. (i) 36 United States Code, subtitle II, part B, chapter 1541. C. If an eligible patriotic youth membership organization requests to engage in any of the activities listed in subsection A of this section, the school district or charter school must do both of the following after the eligible patriotic youth membership organization requests to engage in the activity or activities at one or more schools operated by the school district or charter school: 1. Schedule a date and time during which representatives of the organization may engage in the activities listed in subsection A of this section. 2. If the organization requests to speak with students, notify the parents and guardians of all students about the scheduled speaking engagement and provide to parents and guardians the opportunity to opt their student out of the speaking ENGAGEMENT. D. A school district or charter school may not discriminate against an eligible patriotic youth membership organization described in subsection B of this section in the use of school facilities for student recruitment outside of the normal school day. E. Except to the extent required by federal law, this section does not require a school district or charter school to allow an organization that is not eligible pursuant to subsection B of this section to engage in student recruitment pursuant to subsection A of this section. F. For the purposes of this section: 1. "Patriotism" means support for the United States Constitution and American government. 2. "Student recruitment" means activities that do any of the following: (a) Encourage student participation in the organization and its activities. (b) Inform students about how the organization may further a student's educational interests and civic involvement. (c) Inform students about how the organization may better a student's school, community and self. END_STATUTE
