LEGISLATIVE COUNSEL'S DIGEST AB 1411, as introduced, Torrico. Legislature: delayed budget bill passage. The California Constitution requires the Legislature to pass a Budget Bill by June 15 of each year. The California Constitution also requires that reimbursement for travel and living expenses of the Members of the Legislature be prescribed by statute passed by a 2/3 vote. This bill would prohibit, if the Budget Bill is not passed by the Legislature and sent to the Governor by midnight on June 15 of each year, payment to the Members of the Legislature of travel and living expenses until the Budget Bill is passed and sent to the Governor. This bill would provide that travel and living expenses that are not paid would be permanently forfeited. This bill would also prohibit Members of the Legislature from engaging in campaign fundraising activities until the Budget Bill is passed by the Legislature and sent to the Governor. Vote: majority. Appropriation: no. Fiscal committee: yes. State-mandated local program: no. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 8904 is added to the Government Code, to read: 8904. (a) If the Legislature does not pass and send to the Governor by midnight on June 15 a Budget Bill for the following fiscal year, in accordance with paragraph (3) of subdivision (c) of Section 12 of Article IV of the California Constitution, payment of living expenses, pursuant to Section 8902, and travel expenses, pursuant to Section 8903, to each Member of the Legislature shall be withheld from June 16 until the date that the Budget Bill is passed by the Legislature and sent to the Governor. Travel and living expenses withheld pursuant to this section shall be permanently forfeited. (b) For purposes of this section and Section 9025.5, "Budget Bill" means a bill that makes appropriations for the support of the government of the state for an entire fiscal year. SEC. 2. Section 9025.5 is added to the Government Code, to read: 9025.5. If the Legislature does not pass and send to the Governor by midnight on June 15 a Budget Bill for the following fiscal year, in accordance with paragraph (3) of subdivision (c) of Section 12 of Article IV of the California Constitution, a Member of the Legislature shall not participate in any campaign fundraising activity from June 16 until the date that the Budget Bill is passed by the Legislature and sent to the Governor.
