LEGISLATIVE COUNSEL'S DIGEST AB 1416, as introduced, Galgiani. Vocational nursing and psychiatric technicians: school accreditation. Existing law requires the Board of Vocational Nursing and Psychiatric Technicians of the State of California, through an official representative, to inspect all vocational nursing schools and psychiatric technician schools when it deems necessary and, based on that representative's report, to determine whether to approve the school as accredited or to exclude the school from its accredited schools lists. This bill would require the board to cause these inspections to be conducted at regular intervals and other times the board deems necessary, and by site visit or review of documents required by the board, or both, as determined by the board. Vote: majority. Appropriation: no. Fiscal committee: yes. State-mandated local program: no. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 2883 of the Business and Professions Code is repealed.  2883. It shall be the duty of the board, through an official representative, to inspect all schools of vocational nursing in this state at such times as the board shall deem necessary. Written reports of the representative's visits shall be made to the board, which shall thereupon approve as accredited such schools of nursing as meet the requirements provided by the board. Upon receiving the report of the representative, if the board determines that any accredited school of vocational nursing is not maintaining the standard required by the board, notice thereof in writing specifying the defect or defects shall be immediately given to the school. If the defects are not corrected within a reasonable time, the school of nursing may be removed from the accredited list and notice thereof in writing given to it.  SEC. 2. Section 2883 is added to the Business and Professions Code, to read: 2883. (a) The board shall, through an official representative, inspect all vocational nursing schools in this state at regular intervals and at other times that the board deems necessary. These inspections shall be conducted by a site visit or by a review of documents required by the board, or both, as determined by the board. As used in this subdivision, "documents required by the board" means only those documents that are relevant to a determination of whether the school meets the requirements of this article as prescribed by the board. (b) The representative shall prepare for the board a written report of the representative's inspection. Based upon the report, the board shall approve as accredited the schools that meet the requirements of this article as prescribed by the board. (c) If the board determines that a school does not meet those requirements, the board shall immediately deliver to the school a written notice of the school's defect or defects. If the school does not correct the specified defects within a reasonable time, the board may: (1) deny initial placement on the accredited schools list of a school conducting its initial class, or (2) remove a school from the accredited schools list. In each case, the board shall deliver to the school a written notice of its action. SEC. 3. Section 4532 of the Business and Professions Code is repealed.  4532. The board shall provide for the periodic inspection of all psychiatric technician schools in this State. Written reports of the inspection shall be made to the board, which shall then approve as accredited the schools which meet the standards prescribed by it. If the board determines from a report that any accredited school is not maintaining its prescribed standards, it shall immediately give the school a notice in writing specifying the defect. If the defect is not corrected the board shall, after written notice, remove the school from the accredited list.  SEC. 4. Section 4532 is added to the Business and Professions Code, to read: 4532.
