LEGISLATIVE COUNSEL'S DIGEST AB 152, as introduced, Carter. Mello-Granlund Older Californians Act: disability: definition. Under existing law, the Mello-Granlund Older Californians Act, the California Department of Aging, and local area agencies on aging administer various programs for elderly persons. This act, with certain exceptions, does not contain a definition of "disability." This bill would define "disability" for purposes of the act as either a mental or physical disability, as those terms are defined. Vote: majority. Appropriation: no. Fiscal committee: yes. State-mandated local program: no. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 9012.5 is added to the Welfare and Institutions Code, to read: 9012.5. "Disability" means "mental disability," as that term is defined in subdivision (i) of Section 12926 of the Government Code or "physical disability," as that term is defined in subdivision (k) of Section 12926 of the Government Code, as appropriate, and as qualified by subdivision (l) of Section 12926 of the Government Code. SEC. 2. Section 9653 of the Welfare and Institutions Code is repealed.  9653. "Person with a disability" means the same as the term is defined by regulations established pursuant to Section 504 of the federal Rehabilitation Act of 1973, as amended in 1992 (29 U.S.C. Sec. 12101 et seq.), and the federal Americans with Disabilities Act of 1990 (42 U.S.C. Sec. 12101 et seq.).
