LEGISLATIVE COUNSEL'S DIGEST AB 738, as introduced, Committee on Environmental Safety and Toxic Materials. Hazardous materials: brownfield cleanup: loan or grant program. Existing law authorizes the Department of Toxic Substances Control to provide loans to eligible entities for the purposes of brownfield cleanup. This bill would authorize the department to administer and implement a loan or grant program consistent with federal regulations implementing the Small Business Liability Relief and Brownfields Revitalization Act, using only federal grant funds if available for that purpose. Vote: majority. Appropriation: no. Fiscal committee: yes. State-mandated local program: no. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 25395.33 is added to the Health and Safety Code, to read: 25395.33. The department may administer and implement a loan or grant program consistent with federal regulations implementing the Small Business Liability Relief and Brownfields Revitalization Act (Public Law 107-118) in accordance with all applicable federal laws and guidelines for those programs, using only federal grant funds if available for that purpose.
