LEGISLATIVE COUNSEL'S DIGEST SB 31, as amended, Cedillo. Community colleges: energy-related projects. (1) Existing law establishes various grant, loan, and loan guarantee programs that are administered by the State Energy Resources Conservation and Development Commission (Energy Commission) to provide assistance to private and public entities to maximize energy use savings in existing and planned buildings and facilities. Existing law requires the commission to administer federal funds allocated to, and received by, the state for energy-related projects pursuant to the federal American Recovery and Reinvestment Act of 2009 or related federal acts. Existing law establishes the California Community Colleges, under the administration of the Board of Governors of the California Community Colleges, as one of the segments of public postsecondary education in this state. This bill wouldappropriaterequire the Energy Commission to award to the board of governors grants in the amount of $20,000,000 from the moneys appropriated to the Energy Commission under the 2009- 2010 Budget Act that are received by the state pursuant to the federal American Recovery and Reinvestment Act of 2009 or related federal acts to the board of governors for purposes of implementing an energy management program including specified components. The bill would require the board of governors to ensure that prescribed requirements are met with respect to implementing the program. (2) The California Constitution authorizes the Governor to declare a fiscal emergency and to call the Legislature into special session for that purpose. The Governor issued a proclamation declaring a fiscal emergency, and calling a special session for this purpose, on January 8, 2010. This bill would state that it addresses the fiscal emergency declared by the Governor by proclamation issued on January 8, 2010, pursuant to the California Constitution. Vote: majority. Appropriation:yesno . Fiscal committee: yes. State-mandated local program: no. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Article 3.7 (commencing with Section 81665) is added to Chapter 3 of Part 49 of Division 7 of Title 3 of the Education Code, to read: Article 3.7. Energy Management Program81665. (a) Notwithstanding any other provision of law, the sum of twenty million dollars ($20,000,000) from the moneys received by the state for energy-related projects pursuant to the federal American Recovery and Reinvestment Act of 2009 (Public Law 111-5) or federal acts related to the federal American Recovery and Reinvestment Act of 2009, is hereby appropriated to the Board of Governors of the California Community Colleges for the purposes of implementing the energy management program described in subdivision (b).81665. (a) Notwithstanding any other laws, the State Energy Resources Conservation and Development Commission shall, consistent with applicable federal laws, award to the Board of Governors of the California Community Colleges grants in the amount of twenty million dollars ($20,000,000) from moneys appropriated to the commission in Item 3360-001-0890 of the 2009-10 Budget Act that are received by the state for energy-related projects pursuant to the federal American Recovery and Reinvestment Act of 2009 (Public Law 111-5) or federal acts related to the federal American Recovery and Reinvestment Act of 2009 for the purposes of implementing the energy management program described in subdivision (b). (b) The energy management program shall include all of the following components: (1) Installation orupgradingupgrade of energy management systems on community college campuses. (2) Integration of energy management systems installation and training into the curriculum of approved green jobs training programs. (3) Development and implementation of an outreach plan that will encourage participation by the community colleges, track outcomes, and education energy consumers. (4) Development and implementation of a plan to enhance energy conservation among faculty, students, staff, and the community. (c) In implementing the program described in subdivision (b), the Board of Governors of the California Community Colleges shall ensure that all of the following requirements are met: (1) Projects implemented with fundsappropriatedawarded by the commission pursuant to this section shall be consistent with the Board of Governors of the California Community Colleges Energy and Sustainability Policy. (2) The California Community College/Investor Owned Utilities Energy Efficiency Partnership and the Foundation for the California Community Colleges shall participate in the fulfillment of the requirements of this section. (3) The Board of Governors of the California Community Colleges provides a match of not less than twenty-five million dollars ($25,000,000) from in-kind contributions, private funds, or any other funds. (d) The Board of Governors shall ensure that moneysappropriatedawarded by the commission pursuant to this section are expended consistent with the federal American Recovery and Reinvestment Act of 2009 and any other applicable federal law. SEC. 2. This act addresses the fiscal emergency declared by the Governor by proclamation on January 8, 2010, pursuant to subdivision (f) of Section 10 of Article IV of the California Constitution.
