 BILL NUMBER: AB 1192AMENDED BILL TEXT AMENDED IN ASSEMBLY APRIL 25, 2011 AMENDED IN ASSEMBLY APRIL 13, 2011 INTRODUCED BY Assembly Member Garrick FEBRUARY 18, 2011 An act to add Chapter 3.5 (commencing with Section 120460) to Part 2 of Division 105 of the Health and Safety Code, relating to public health. LEGISLATIVE COUNSEL'S DIGEST AB 1192, as amended, Garrick. Immunization information: pertussis. Existing law creates various programs relating to requiring and distributing information relating to immunizations for various communicable diseases. This bill would require  , during the postpartum period and prior to discharge, a hospital to provide parents of newborns with   the State Department of Public Health to post on its Internet Web site  specified information relating to pertussis.  The bill would also authorize hospitals to distribute this information to parents of newborns.  Vote: majority. Appropriation: no. Fiscal committee: yes. State-mandated local program: no. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. The Legislature finds and declares all of the following: (a) The federal Advisory Committee on Immunization Practices, part of the federal Centers for Disease Control and Prevention, has issued recommendations for the use of the pertussis vaccine, stressing the importance of routinely vaccinating those with close contact with infants. (b) This issue is particularly important in California due to the ongoing pertussis epidemic. In 2010, over 9,000 cases were reported to the State Department of Public Health-- more cases than in any of the  preceeding   preceding  65 years. (c) The most severe disease occurs in infants three months of age or younger. Many of the 2010 cases occurred in infants, and 10 infant deaths were reported. (d) In the first three months of 2011, 514 cases of pertussis were reported. SEC. 2. Chapter 3.5 (commencing with Section 120460) is added to Part 2 of Division 105 of the Health and Safety Code, to read: CHAPTER 3.5. IMMUNIZATION EDUCATION  120460. (a) During the postpartum period, prior to discharge, a hospital shall provide parents of newborns with all of the following information: (1) The risks of pertussis, especially as those risks pertain to infants.   120460.   (a) The department shall make available on its Internet Web site information for use by hospitals that includes all of the following information:   (1) The signs of pertussis, also known as whooping cough.  (2) The availability of a vaccine to protect against pertussis. (3) The recommendation of the federal Centers for Disease Control and Prevention that those with close contact with newborns receive vaccination against pertussis.  (b) Hospitals may distribute the information provided by the department to the parents of newborn children.   (b)   (c)  Nothing in this section shall require a hospital to provide or pay for vaccination against pertussis.
