An act to add Section 1261.3 to the Business and   Professions Code, relating to clinical laboratories.  LEGISLATIVE COUNSEL'S DIGEST AB 1328, as amended, Pan.  Professions and vocations.   Clinical laboratories.  Existing law provides for the licensure and regulation of  various professions and vocations by boards and bureaus within the Department of Consumer Affairs and places the department under the control of the Director of Consumer Affairs. Existing law authorizes the director to request specified reports from these boards   clinical laboratory personnel by the State Department of Public Health. Existing law authorizes the department to issue a clinical laboratory scientist's license to an applicant who is the lawful holder of a baccalaureate or an equivalent or higher degree and who meets specified training and experience requirements, subject to the payment of a licensing fee  . This bill would  make nonsubstantive, technical changes to that provision   ,  notwithstanding those provisions, authorize the department to issue a clinical laboratory scientist's license to an applicant who completes at least 2 years of full-time employment as a clinical laboratory scientist at a CLIA certified laboratory, who possesses a baccalaureate or an equivalent or higher degree from an accredited institution, and who passes a national examination approved by the department, subject to the payment of the requisite licensing fee  . Vote: majority. Appropriation: no. Fiscal committee:  no   yes  . State-mandated local program: no. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:  SECTION 1.   Section 1261.3 is added to the   Business and Professions Code   , to read:   1261.3. Notwithstanding Section 1261, the department may issue a clinical laboratory scientist's license to a person who meets all of the following requirements: (a) Completes at least two years of full-time employment as a clinical laboratory scientist at a CLIA certified laboratory. (b) Possesses a baccalaureate or an equivalent or higher degree from an accredited institution. (c) Passes a national examination approved by the department. (d) Applies for the license on forms provided by the department. (e) Pays the fee for licensure specified in Section 1300.   SECTION 1.   Section 127 of the Business and Professions Code is amended to read: 127. Notwithstanding any other provision of this code, the director may require reports from any board, commission, examining committee, or other similarly constituted agency within the department as he or she deems reasonably necessary on any phase of their operations.
