An act to add Section 51798 to the Education Code, relating to school gardens.  LEGISLATIVE COUNSEL'S DIGEST AB 2367, as amended, Bonilla.  School safety: gates to school grounds.   Instructional school gardens: sale of surplus produce.   Existing law establishes the Instructional School Gardens Program for the promotion, creation, and support of instructional school gardens. Under existing law, a school district, charter school, or county office of education may apply to the Superintendent of Public Instruction for funding for a 3-year grant in order to develop and maintain an instructional school garden. Existing law limits the grants to a maximum of $2,500 per schoolsite, except as provided.   This bill would authorize a school district, charter school, or county office of education to sell surplus produce grown in an instructional school garden.   Existing law requires the governing board of a school district and the governing authority of a private school that maintains any building used for the instruction or housing of pupils on land entirely enclosed by fences or walls to provide for the erection of gates in those fences or walls that are of sufficient size to permit the entrance of ambulances, police equipment, and firefighting apparatus used by law enforcement and fire protection agencies, subject to specified requirements.   This bill would make technical, nonsubstantive changes to these provisions.  Vote: majority. Appropriation: no. Fiscal committee: no. State-mandated local program: no. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:  SECTION 1.   Section 51798 is added to the   Education Code   , to read:   51798. A school district, charter school, or county office of education that is operating an instructional school garden program pursuant to this article may sell any surplus produce grown as part of the program.   SECTION 1.   Section 32020 of the Education Code is amended to read: 32020. The governing board of every school district, and the governing authority of every private school, which maintains any building used for the instruction or housing of school pupils on land entirely enclosed (except for building walls) by fences or walls, shall, through cooperation with the local law enforcement and fire protection agencies having jurisdiction of the area, make provision for the erection of gates in those fences or walls. The gates shall be of sufficient size to permit the entrance of the ambulances, police equipment, and firefighting apparatus used by the law enforcement and fire protection agencies. There shall be no less than one access gate and there shall be as many gates as needed to ensure access to all major building and grounds areas. If the gates are to be equipped with locks, the locking devices shall be designed to permit ready entrance by the use of the chain or bolt cutting devices with which the local law enforcement and fire protection agencies may be equipped.
