LEGISLATIVE COUNSEL'S DIGEST AB 425, as introduced, Nestande. State regulations: review. Existing law authorizes various state entities to promulgate and implement regulations, subject to specified criteria. This bill would require, no later than December 31, 2012, each state entity that promulgates regulations to review those regulations, and repeal or report to the Legislature those identified as duplicative, archaic, or inconsistent with statute or other regulations. It would also require these entities to report to the Legislature by that date on regulations deemed to inhibit economic growth in the state. Vote: majority. Appropriation: no. Fiscal committee: yes. State-mandated local program: no. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 11342.5 is added to the Government Code, to read: 11342.5. Each state entity that promulgates regulations shall review those regulations, and no later than December 31, 2012, do either or both of the following, as applicable: (a) Identify regulations it deems to be duplicative, archaic, or inconsistent with statute or other regulations and do either of the following: (1) Repeal the regulations as authorized by law, if possible. (2) If it is not possible to repeal the regulations, report to the Legislature on the legislative or other action needed to repeal them. (b) Identify and report to the Legislature on regulations it deems would inhibit economic growth in the state.
